<br />Section 1133.10 governs the factors that should be reviewed prior to making a <br />decision as to whether or not something that is not specified should be a <br />permitted use. He read the standards of that section tahich should be applied. He <br />clarified that under the old code this would have been a function of the Board of <br />Zoning Appeals, however this is now ane of the Commission's responsibilities. Mr. <br />Conway stated that there were apparently others in town, but he has had no <br />complaints on any of them. He stated that the Fire Department and the Board of <br />Health had inspeeted it, and neither had any objection. Mr. Thomas did not <br />believe that it would be any more offensive than a barbecue. The members ha.d no <br />problem. Mr. Conway clarified that this would be governed under the zoning code <br />as far as the percent of the coverage allowed in the rear yard and any smoke <br />house would need a permit and would have to follow the setbacks, lot coverage, <br />but it should be stipulated that this is for the use of the owner, that food is <br />not being processed for other people. r5r. Thomas asked to defer the motion until <br />later. Shortly after Mr. Thomas moved to approve the accessory use of a smoke <br />house in a Residential District as defined in Chapter 1135 of the Zoning Code. As <br />long as a smoke house structure meets all the requirements of builcling, safety, <br />and health authorities, and tha.t the use of the smoke house is only for the <br />benefit of the resident/owner and no retail or wholesale commerce related to the <br />smoke house or smoke house activities take place an the property, seconded by K. <br />0'Rourke, and imanimously approved. <br />Regarding the Day Care in the General Retail district, the Law Department has <br />ruled that this use would have to come before the Commission for a conditional <br />use-permit. Conditional uses are regulated.by.the•district that they fall <br />within. <br />Regarding Nursing Homes in the Senior Residence District, Mr. Conway advised <br />that he is working an some changes in the Elderly Housing 'District in order to <br />incorporate different uses in the district and this will be reviewed by the Law <br />Department prior to coming before the Comnission. Mr. Gorris asked if he was <br />considering height restrictions in this district, since in the Elderly Housing <br />District there is a seven story restriction; and in the Mixed Use "D" there can <br />be elderly housing limited to 4 stories. :Mr. Conway advised that he is trying to <br />give as much flexibility as possible so:the Commissian can set the parameters. <br />In reference to the Boston Chicken proposal, they asked to be tabled at the <br />Board of Zoning Appeals meeting. Mr.-Conway believed that the Board was going to <br />deny the request and that the representative wanted to talk to his superiors. <br />This will be heard again June 9th. . <br />Mr. Conway had presented several minor change requests,previously. <br />C.E.I. had requested to install lights on three separate locations. The first <br />was at Lorain Road and West 231st where they wish to install two new 400 watt <br />fixtures and re- direct the fixture in the center of the lot. He noted that the <br />poles are currently existing. in the right of way. These are standard C.E.I. <br />poles. There is concern for safety because the parking lot is not too well <br />lighted..He has talked to some of the neighborhood, and the light closest to West <br />231 is existing and there were no complaints about it. Mr. Gorris wants to make <br />sure that they contain the light an the property. The ETectrical Inspector did <br />not find a problem with the lighting. <br />There is also a request at 26618 Brookpark Road Extension (Suburban Auto Body, <br />where they want to install a 400 watt lamp located 12. feet from the Nvest and <br />south property lines. This is in a comercial district and there is a mound <br />adjacent to the residential district. Mr. Gorris had no problem with this <br />request. <br />3
