She <br />believed that if this problem were addressed, tlie residents might be more receptive to this <br />proposal. Mr. Bolilmann, Service Director, stated that this service road had been cited every year <br />by the property maintenance inspector, and the owners have made only temporary repairs which <br />do not last. The city has refused to take over the road for a public right of way. He stated that <br />Mr. Papandreas has agreed verbally, and it should be noted for the record, that they will repair the <br />road from the end of the city right of way due north to where it turns the corner upon the <br />approval of tlus project and he has assured him that before this censtruction season is over, they <br />will bring the road up to proper staudards. He clarified that this was the area from city right-of <br />way (where the new concrete ends) due north will be replaced, and before the end of the <br />construction season he will address the road to the far westerly end of Country Club Blvd. The <br />residents were still concemed about the other problems. In reference to the service drive, Mr. <br />Papandreas re-affirmed that they are committed to trying to improve the service drive, and will be <br />evaluating what is needed on the road from the intersection of Country Club Boulevard and <br />Victoria Lane, north to where it proceeds westward to the service drive (behind Plaza North). <br />They will also evaluate improvements to the service road behind Plaza North, and they must get <br />together with both the city anci condominium owners or their representatives because there is an <br />agreement that clearly identifies that the condominiums are requ.ired to share in the expense of <br />those improvements. They have not done this in the past, but now that they are looking at <br />tremendously expensive road repairs, they are going to be looking into that agreement more <br />closely. They understand the concerns expressed here, but they must evaluate the situation before <br />making any commitment. Regarding the access road, Mr. Hogan was advised that there was no <br />load limit on that road because it is private and fu.rther that the city would not be liable if someone <br />were hurt due to the condition of the road. He questioned who would be liable if someone were <br />injured due to the condition of the road. Mr. Hogan asked if there would be more traffic as a <br />result of tlus project. Mr. Papandreas responded that they are eliminating 5 loading and service <br />areas behind Plaza South and will be combining them into a single loading platform to the north <br />and maintained that the truck traffic generated would be less than with the previous tenants. Mr. <br />Hogan noted that if the loads were heavier they would have more impact on the road. M.T. <br />Johnson, a real estate representative of Best Buys, and Mr. Dow, the regional managers, <br />addressed these issues. Mr. Johnson stated that, because of security, they do not allow any <br />loading from the rear of the store, this is a set policy. Secondly, they use a trash compactor with a <br />roll off bin which typically is uuloaded every two to three weeks, and they generate only <br />cardboard, not garbage. Again, Mr. King repeated that all noise in that area echoed of the brick <br />walls and relocating the truck dock would create more of a nuisance for their building. Mr. <br />Johnson could not argue that, but again pointed out that there would one dumpster replacing five <br />and it would be unloaded once every 2 or 3 weeks. They are not like Handy Andy, they do their <br />distribution out of two centers, all the smaller goods come out of Minneapolis in full semi truck <br />loads with two to three loads a week arriving at 8:00 or 9:00 a.m. and leaving by noon. Again the residents complained about trucks ruuuing their motors all night long. Mr. Johnson stated that <br />they do have some control over the deliveries, because they have a limited nu.mber of d.rivers, but <br />it does not always work. All their T'Vs come from a joint distribution center, two or three times a <br />week. The refrigerators will come from a local store and will be delivered during the day about <br />twice a week. He clarified that Handy Andy had a drop ship operation, they take little out.of their <br />own distribution yards, and have an entirely different type of operation. He clarified that they <br />store uothing outside, the dumpster is emptied through a chute inside the store. He was not sure <br />what trucker would be used in this area, but they only use one, and they come from Bloomington, <br />4
