fencing placed on that mound; that the H.V.A.C. roof top units be screened on all sides; and also <br />additional climensions on all pla.ns. I would also like the Engineering Department to take a look <br />the grading on the property regarding gravity versus a lift station to see which would be the best <br />retention for both the residential and commercial neighbors in the whole general area. Mr. Tallon <br />added that he would like information regarding any restrictions that could have been placed on the <br />properiy by the EPA. The motion was seconded by L. Orlowski Roll call on motion: Thomas, <br />Orlowski, Miller, O'Rourke,. Tallon, and Gorris, yes. Mrs. Cameron Alston had left the room <br />temporarily. The motion carried. Duriug the framing of the motion, Mr. Thomas and Mr. Miller <br />discussed the stacking lane and widening Dover Center Road, and Mr. Thomas stated that he did <br />not want to give them an alternative to include a Dover entrance and pointed out that there are <br />other accesses on Dover Center Road and it would be possible that Heller's could be sold to <br />another retailer, possibly a fast food restaurant, who would demand access on Dover Center <br />Road. He saw no need to consider additional accesses on Dover Center Road. Mr. Papandreas <br />commented that, based on their studies, eliminating both the Dover and Mill Road accesses would <br />be clifficult to subscribe to. He understood eluninating the Mill Road access, but every study <br />conducted by traffic consultant has stated that additional accesses are requ.ired, and although they <br />are willing to work with the Commission, they cannot violate and go against these very strict and <br />consistent recommendations of the experts. They do not believe this would be in the best interest <br />of the city. Mr. Thomas explained that there are 5 access, legal curb cuts, existing on Dover <br />Center Road between Mill and Lorain Road this would create 6 accesses which could potentially <br />cause a problem that would be ineparable. Mr. Papandreas questioned how the Plarining <br />Commission could go against the recommendations of the City Traffic Engineer, and some of the <br />best traffic consultants in the city. He understands the reason, but not the logic. He asked that the <br />Commission look at the over all picture in their considerations. JEs premise is that the traffic is <br />going to be there, getting it offthe road and back onto the road with right turns in and out, is the <br />best solution to the problem, it will not eliminating the curb cut which would continue the <br />stacking distance down Dover Center. Mr. Thomas asked that, since they do not have an option <br />on Heller's Restauraut, Mr. Papandreas assume that a fast food restaurant that generates a lot of <br />in and out traffic decides to buy Heller's, how could the Plauuing Commission justify 'this curb cut <br />with the Heller's 3 legal curb cuts that close to each other. At this point, Heller's is not doing <br />much business, and the other two are not high traffic generating businesses but all that could <br />change. Mr. Papandreas believed that the Commission could deal with that during their review of <br />those businesses. Mr. Thomas agreed to a compromise that they return with a revised plan <br />showing no curb cut on Dover Center Road, but with an overlay that shows the curb cut and Mr. <br />Miller's request for a stacking lane, but he must also include the existing legal curb cuts between <br />Mill Road and Rally's. He could also present an overlay with the Mill Road access. Mr. Gorris <br />stated that the Commission had asked Wal-Mart to limit the access into this parcel, and they knew <br />what kind of traffic they would generate, but they have not been given this information for this <br />parcel. They have only given information on the type-of businesses that they hope to have, but if <br />they cannot get those, they will have to fill the space and there could be more traffic than <br />anticipated. He noted that this has a 50% more development than Wal-Mart originally proposed. <br />N1r. Papandreas understood the Commission's intent, but he firmly believed that there was a need <br />to evaluate tlus from the perspective of the experts in the industry. He agreed to show what has •been requested, and will work with the city and will present the information that the engineers . <br />ueed, but since this could be doing a disservice to the city, he asked that the members reconsider <br />the experts' opinions. W. Gorris stated that he was not pleased with this parcel being zoned <br />retail, and he intends to uphold the law as well as respect the rights of the developer, however, as <br />9
