"I <br />November or early December of 1992 and have lived in the home since. Mr. Duffy asked if Mr. <br />Kettle had any knowledge of what access Mr. Simmons would have to get into the home to <br />correct the problems. . Mr. Kettle acknowledged that one letter was sent to Mr. Simmons in <br />October of 1993 and he has met with Mr. Simmons in the Building Commissioner's office and he <br />believed that it was after that letter was sent. Mr. Simmons had not been notified of the ventilation <br />problem that had been discovered the previous day, however he had been notified of the previous <br />problems with the vents. At the time he checked that more vents had been installed, but he did not <br />total up the amou.nt that was done to make sure that there was the exact amou.nt, and his report <br />shows that they are not that far off what it required. He clarified that he noticed the excessive <br />condensation when most of the vents were missing, before the additional ones were installed. Mr. <br />Simmons also vented the fan vents for the bathroom directly to the outside, so they would not <br />back up into the attic space. He stated that at that time, it appeared that the problem of excessive <br />condensation had been corrected; however, he liunself did not notice any excessive condensation <br />during his inspection yesterday but he was shown a video tape of the attic area which showed <br />frost on the insulation in the attia W. Duffy had no further questions. Mr. Kettle advised Mr. <br />Burk that all the items'listed were coirectable_ and that during the course of the construction, Mr. <br />Simmons had corrected violations which had been pointed out to him. In response to Mr. <br />Gareau's questions, Mr. Kettle advised that there had been some problems, other than code <br />violation, specifically some nails were placed'incorrectly in the window casings, the Anderson <br />windows do have specified areas where nails should not be placed. In response to Mr. Gareau's <br />questions, Building Commissioner Conway advised that he had been Building Commissioner of <br />the city of North Olmsted since Ju1y of 1987 and his duties are to oversee the Building <br />Department and is in charge of all inspections of new construction and remodeling. Ms office also <br />handles the registration of all contractors who work within the city limits. There are certain_ <br />conditions if a violation is found under which he can refer a license of a contractor to this boaxd <br />for revocation. He clarified that if he found outstanding violations the code gives him the <br />authority to refer it to the board for the suspension of the license. In reference to this case, Mr. <br />Conway advised that Mr. Kettle had brought some of the difficulties that were occurring at this <br />job site, he had observed some of these when he visited the job site. W. Kettle subsequently <br />contacted the contractor in order to resolve these problems. He then notified Mr. Conway by <br />memo on October 28th that these repairs had not been made and that there were existing code <br />violations. Mr. Conway then sent a letter to Mr. Simmons referring to all the violations (1 through <br />4) and requiring that all violations had to be repaired by November 28, 1993. Since these <br />violations have not been repaired and he was unsuccessful in his attempts to get the contractor <br />and home owner to work out the issues, he brought this to the board's attention. At this time he <br />would recommend that the board order Mr. Simmons to make the repairs or suspend his license. <br />Mr. Duffy clarified that the notice of the violations was given in 1993 and that since that time the <br />violations have not been- corrected, and asked if Mr. Conway had any personal knowledge of <br />whether or not Mr. Simmons was given access to the property to correct the problems. Mr. <br />Conway advised that he has no personal knowledge, but he has heard some statements. In <br />reference to conversations between the home owner and the contractor, Mr. Conway advised that <br />he was told about them by Mr. Kettle and he tluuks he talked to Mr. Simmons about these <br />conversations and also he has talked with Mr. Dugy about them. He was made aware of the law <br />suite that was filed about 2 months ago, he was not sure of exactly when. Mr. Gareau stated that <br />the city had nothing further to add.
