Boyle moved to grant to Andre LeBlanc, Sr, 30447 Lorain <br />Road his request for a variance to conduct business in the 75 foot front set back. Violation of Ord. <br />90-125, Section 1139.07. Temporary variance was granted August 4, 1994. Heard by Plauning <br />Commissiou October 25, 1994. With the request that this Board grant his request. The motion was <br />seconded by T. Koberna. At the point, Mr. Gomersall asked the members to consider that this board <br />had denied use of the 75 foot front set back to Affordable Cars on Lorain Road and to a lesser <br />degree to other car agencies. Roll call on motion: Boyle and Koberna, yes. Maloney, Puiper, and <br />Gomersall, no. Motion failed to pass. Variance denied. <br />12. Richard Gudat. Jr. 28009 Wisteria Drive <br />Request for variance (1123.12). Request 8 foot rear set back variance and 3 foot side set back <br />variance to install shed. Violation of Ord. 90-125, Section 1135.02(d)(4). <br />Chairmau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Gudat. Mr. Gomersall noted that there was a lot of correspondence on the case from five neighbors <br />who were objecting to the request. Mr. Koberna believea that most of the objections were because <br />the shed would be in the swale. Mr. Gudat stated that the swale was no longer necessary since it was <br />put in before there were storm sewers and most of them had been filled in. Building Commissioner <br />Conway advised that Assistant City Engineer McDermott had verified that this was still a recorded <br />easement. It was noted that the size of the shed conforms to the code. Since the shed cannot be <br />installed in the five foot easement, Mr. Gudat agreed to a 3 foot rear yard setback. R. Gomersall <br />moved to graut the 3 foot rear yard setback and a 3 foot side set back variance to install shed. <br />Violation of Ord. 90-125, Section 1135.02(d)(4). The motion was seconded by W. Puiper, and <br />unavimously approved. Variances granted. <br />13. Star Bauk 25900 Country Club Blvd <br />No representative was present. A motion was made to continue the proposal at the end of the <br />meeting. <br />14. William Stanicki. 31083 Lorain Road <br />Request for variance (1123.12). Request a 340 square foot area variance, and a 5 foot height <br />variance to convert and enlarge existing carport to use as an accessory building to store boat. Also <br />request variance to have second shed on property. Violations of Ord. 90-125, Section 1135.02(d)(1) <br />and (d)(3). Also request special permit to enlarge non-confomiing building. Special permit required <br />Ord. 90-25 1165.02(b)(1). <br />Chainnan Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Stanicki. The members had no problem with the request since this is a deep yard and is not in a <br />residential area. J. Maloney moved to grant the request of William Stanicki, 31083 Larain Road for a <br />340 square foot area variance, and a 5 foot height variance to corivert and enlarge existing carport to <br />use as an aecessory building to store boat and to grant the request for a variance to have second shed <br />on property. Violations of Ord. 90-125, Section 1135.02(d)(1) and (d)(3). Also to approve the <br />special permit to enlarge a non-conformiug building. Special permit required Ord. 90-25, Section <br />1165.02(b)(1). The motion was seconded by T. Koberna, and unauunously approved. Variances and <br />special permit granted. <br />6
