Maloney moved to grant the request of Metro Infinity, 28400 Lorain Road, the <br />variance to have a second wall sign; a 5 foot, 7-11/16 inch height variance; a <br />66.5 squa.re foot variance for total sign area for the building; and a 66.5 square <br />foot total sign area for a business use, the variance for the logo is a <br />replacement of their original request, seconded by R. Gomersall, and imanimously <br />approved. Variance granted. <br />5. Elias Brothers Restaurants, Inc., 26700 Lorain Road. <br />Request for ruling (1.123008). Request ruling that the correctness of the <br />Building Official's determina.tion that the Big Boy statue is a sign and must be <br />appealed tmder Ord. 90-125, Sections 1163.11(A) and 1163.12(b). <br />If the determination is upheld that the statue is a sign: <br />Request for variance (1123.12)e Request 56.50 square foot variance for total sign <br />area for a business use; request 89 square foot variance for free standing signs; <br />and request variance to have a second free standing sign (one allowed). <br />Violations of Ord. 90-125, Section 1163.11(a); and 1163.12(b). <br />This proposal was withdrawn by the applicant tmtil next month. <br />6. Nuevo Acapulco, 24399 Lorain Road. <br />Request for variance (1123o12)a Request variance to change faces in 2nd <br />prohibited wall signm Also request variance to replace faces on second prohibited <br />pole sign (please note: sign does not conform to 5 foot setback required from <br />front property line nor 5 foot setback required fram side property line for all <br />freestanding signs and it is located in the 35 foot prohibited triangular area <br />for free standing signs). Violations of Ord. 90-125, Sections 1163.12(a) and <br />1163.22(a). <br />Chairman Gomersall called a11 interested parties before the boarde The oath was <br />admi.nistered to Mr. Kahn, sign contractor, Ms. Rose, representing the owner, and <br />President of Council J. Boehmer, who operates a business near by. Mr. Katui <br />advised that he has advised the owner that the pole sign will have to be removed <br />by January 1, 1998. Ms. Rose advised that this is a new business and the owners <br />wish to use the existing sign cabinets, but the owners are willing to comply with <br />the new codes by 1998 when non conforming signs must be removed. She also would <br />like a clarification of the regulations pertaining to "Grand Opening" signs. <br />Building Commissioner Conway told her that they could only put a sign in the <br />window and someone else thought that this had been changed. Mr. Conway advised <br />that the board could grant a variance for a grand opening sign, but there was <br />only talk of changing the ordinance. TJIr. Kahn advised that they wanted a 13 by 22 <br />foot banner that would be the size of the wall sign tmtil the germanent signs are <br />installed. It was agreed that a banner could be used from January 19th until <br />February 12th. R. Gomersall moved to grant the request of Nuevo Acapulco, 24399 <br />Lorain Road, to change the face of the second prohibited wall sign; to replace <br />faces on' the second prohibited pole sign and to grant their request for a 2-z by <br />13 foot temporary "Grand Opening" sign for the period from January 19th to <br />February 12th, seconded by J. Maloney, and tmanimously approved. Variances <br />granted. <br />7. Greg D. Crough, 4572 Dover Center Rdo <br />Request for variance (1123.12). Request 3 foot side set back variance to replace <br />existing detached garage. Violation of Ord. 90-125, Section 1135.02(c)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Crough who explained that they want to put the new garage <br />Nahere the original garaga was located. This garage will be larger and he intends <br />` 3
