,.. <br />Chau-inan Gomersall called all interested parties before the board. The oath was ad.ministered <br />to Dennis and Brian Carlton who advised that the one address was 29494, not 2959 as stated <br />on the agenda. They clarified that they actually want an 8 foot fence placed on a mound in <br />order to obscure the trailers next door which are up fairly high. Three prospective buyers have <br />refused to buy because of the mobile home park which is in Olmsted Township. Brian Carlton <br />explained that the mound would vary in height from 1 foot to 18 inches, depending on the <br />elevation. Law Director Gareau stated that there have been ma.ny problems with this trailer <br />park, and also with the new one, but since they are in the township, there was nothing the city <br />could do. He e}cplained that the Mayor has asked the owner to build fences to shield the <br />abutting North Olmsted residents, but he refused. Mr. Carlton stated that the owner had no <br />objection to lus doing this as long as he did not have to pay for it. Building Commissioner <br />Conway advised that elevations and changes in grade would have to be approved by the <br />Engineering Department. He stated that if there were a fence on a hill on an existing property, <br />he would measure the fence from the top of the hill because that is the existing grade. So if <br />Engineering approves the mound, he would approve the fence from the top of the mound. Mr. <br />Tennant, a building inspector, had made recommendations that the support posts be 6 by 6 <br />inches instead of 4 by 4 in order to support the height. of the fence and that the posts should <br />be set in the ground to a depth equal to 1/2 of the height of the fiuished fence. Mr. Conway <br />etcplained that the 6 by 6 inch posts would be border line, but the'distance in the ground would <br />dependent on the height. Mr. Gareau advised that this would be up to the Building <br />Department, not this board. J. Maloney moved to grant the request of Dennis Carlton, <br />29435, 29465, and 29454 Vita Lane for a 2 foot height variance for a fence on the grade <br />approved by the Engineering Department. Violation of Ord. 90-125, Section 1135.02(fl). The <br />motion was seconded by W. Purper, and unanimously approved. Variance granted. <br />6. Ice Cream Parlor, 27045 Lorain Road. <br />Request for variance (1123.12). Request 10 foot rear yard variance to relocate trash <br />receptacle. Request variance to allow outdoor seating in front setback. Request variance for <br />the 10 parking spaces needed to accommodate 20 additional seats. Violation of Ord. 90-125, <br />Sections 1139.07 (table and note to table); and 1161.05(c). <br />Chairman Gomersall called all interested parties before the board. The oath was administered <br />to Mrs. J. Benik and her son, Mr. W. Benik, who explained that the locarion of the trash <br />receptacle had been approved at 10 feet away from the property line, now he is asking to <br />locate it 3 feet from the property line (this request initially was for a 10 foot variance which <br />would have placed it right on the property line)..He clarified that there will be a three foot <br />landscape buffer behind the trash receptacle, the rest of the area will have a 10 foot landscape <br />buffer. The adjacent resident, Mr. Urban, was present and was sworn in at this time. He was <br />concerned that the trash receptacle would be moved closer to his house, but he now <br />understands that it will be closer to the parking area. Mr. Gomersall was concerned about <br />adding 20 more seats and granting a variance for 10 parking spaces since customers would <br />have a problem parking. Mr. Benik contended that because of the adjacent schools, the church <br />and the pedestrian traffic in the area there would be many walk up customers. He believed that <br />if a customer drove in and there were no parking spaces, they would merely pull out. The <br />members did not believe that there would be that number of walk in customers.
