Jolui Silver's, but he does not believe that the restaurant needs that many spaces. He also <br />believed that the peak times for these two facilities are different. Building Commissioner <br />Conway advised that for this type facility, 88 parking spaces would be required and they <br />show 80 (including the landbanked spaces). However the 6 paved landbanked spaces, east of <br />the structure, would limit the drive to one way (in the event they had to be used) and the <br />first three landscaped landbanked spaces would not allow for a 55 foot loading area as <br />required by code, even though it would accommodate the small truck which is their normal <br />delivery vehicle. The east drive would be about 10 feet wide if the land banked parking were <br />used. Mr. Stitz thought that the truck dock could be moved to the east. Mr. Conway advised <br />that that two load.ing zones are required by code; and by taking away the Long John Silver's <br />property, they are creating a more non-conforming lot since a-restaurant is required to have <br />roughly 65,000 square feet, they now have approximately 40,000 and will be going down to <br />about 28,000. In response to questions, Mr. Conway advised that if they reduced the <br />building to 10,000 square feet, they would only need 1 loading zone and would reduce the' <br />parking requirements by 7 spaces. Mr. Stitz stated that company has ma.ny facilities and are <br />aware of what their parking needs are. Mr. Mauuiug questioned what else could go into <br />Long John Silver building if it went out of business. He was concemed that this would be <br />creating 2 non-confii7niug lots. Mr. Conway responded, if they get the variauce, any retail <br />business could go thexe. The removal of the gas tanks is the responsibility of BP and the <br />State of Ohio will oversee that. The representatives have not done a study of how many cars <br />are generated by BP, but believe this business will generate far less. Mr. Miller noted that <br />there were other landscaped areas where they could add spaces. Mr. Conway advised that <br />the restaurant is required to have 42 spaces, they had 33 paved, and 18 landbanked, <br />currently they have 28, which makes them 14 spaces short, but there will be some shared <br />parking. Some kind of cross easement would be required. Mr. Stitz clarified that the set back <br />of the store was 91 feet and all utilities will be underground. He did not believe that the <br />medical building parking behind this structure was usually fu1L He advised that they moved <br />the curb cut to avoid splitting the Long John's parking, and also believes most of the cars <br />will go out on Lorain Road. There is about 190 feet from the drive to the next residential <br />drive. Assistant Law Director Dubelko advised that with the approval of the proposal the <br />existing curb cut would be abandoned. Mr. Sheppard stated that they would take care of this <br />and it was part of the cross easement agreement. Mr. Conway does not have the signage <br />proposal and does not know if any variance are required for signs. Both properties will be <br />required to go to the Board of Zoning Appeals. Mr. Stitz presented pictures of other <br />facilities and advised that this build.ing would be similar. The members studied the proposal <br />and discussed it among themselves. The residents were invited to speak at this time. It was <br />clarified for Mr. Calmer, a resident, that there would only be two drives on Root Road. He <br />asked who would be responsible for tlie gas well on the property. Assistant City Engineer <br />McDermott advised that that well had been capped at the time that Long John Silver's was <br />constructed and that the venting was required when a well is capped. Mr. Calmer also was <br />concerned because the rain ground water re-charge area was being decreased with the new <br />black top. Mr. Stitz believed that it would be a close balance, because they were eliminating <br />some of the paving that had been there before. Mr. McDermott advised that a retention <br />system would be required and would recharge the ground water. Mr. Johnson complained <br />that he could not get out of Root Road now and questioned why they have to have a drive <br />D <br /> <br />2
