The proposal regarding the right of way West <br />231 Street will remain u.nder oonsideration, and he believed that Dr. Gaitanaros had been favorably <br />inclined to consider it, however, he had been out of town for surgery'and passed away during the <br />surgery. Mr. Tallon advised the audience of a memo sent by the Law Department advising that the <br />Plaiuung commission is to rule on the plotting of the parcel, it does not entail storm water systems, <br />traffic, safety, economic property values, environmental wet lands, aesthetics, and housing types. It is <br />based on the ordinances of the City of North Olmsted and if this plotting complies with those <br />ordinances. Mr. Levar, a resident, objected since the neighbors came prepared for one thing and now <br />they are starting to get curves; and he is concemed at this time, that changes have been made to the <br />development. Now the commission 'is coaching the residents on only talking about one thing, and he <br />does not understand. The people in this development are concerned about the development. There has <br />been a major advertisement in a local magazine section indicating that this development seems to have <br />the blessing of the community without their having proper ownership of the property, at this time. He <br />questioned if Mr. Whitlatch was the owner of the property or did he have an option. He went on to <br />say that as of early today he still had an option available, and questioned why they were here if he had <br />an option and what is going on in the city to allow this to occur if it has not been properly debated <br />through the Planning commission and had an open hearing. Mr. Tallon responded that this is what is <br />they are doing. Mr. Mauning responded that their community had sent a letter stating its concems and <br />blocked them off in order of importance, and now the Law Department has cautioned the commission <br />as to wliat their duties were under the code and the codified ordinances' of North Olmsted. This is just <br />a preliminary plan, the plotting and charting of this property. As far as the ownership goes, if he does <br />not own the properiy, he will not be able to build on it. As far as the city is concerned, it must be <br />determined if it is residential, and it is; and it must be determined if it is within the codes, and as it <br />stands now, he is asking for no variances what so ever. Drainage, storm sewers, sanitary sewers, <br />traffic, all those issues will be discussed at later stages and the Engineering Department willhave to <br />review to make sure it will be able to be maintained in the system. Mr. Levar believed that, what Mr. <br />Mauuing was saying was, that this is approved. Mr. 1Vlanning responded that the commission only <br />makes reeommendations. Mr. Levar viewed the plat and stated that the residents still had some <br />concerns and noted that everything was going to abut everybody else's' property and again questioned <br />if everything complied to code. He was advised that it did. Mr. McDermott restated that this was just <br />a platting. Mr. Tallon advised that the platting merely divided the land up into individual plots that had <br />to meet the codes, the square footage, the frontage, and the setback line of the lots. Mr. Levar asked if <br />the city had taken into consideration the major subd.ivision and the cul de-sacs, everythiug else that is <br />all done by code. He questioned if Mr. Tallon was sure, and reiterated the question. He further asked <br />when the code was last reviewed. Mr. Tallon believed that it was reviewed around 1988. Councilman <br />McKay advised the code was reviewed in 1989 and was accepted in 1991. Mr. Levar stated that he <br />wanted to remind the commission of something which he hoped would be verbatim on the transcript <br />of their fiduciary responsibility to the citizens of North Olmsted. Mr. Belito, a resident, wondered <br />why the chairinan had asked them to express their concerns in writing, and the gentleman from the <br />Law Department never said a word, and they wasted all this time with the people getting together and <br />producing these documents. Then after sitting through two and a half hours of discussion they told of <br />this. He believed that they did the residents an injustice. Mr. Tallon responded that the debate last time <br />was whether there were to be single family homes or cluster homes. Mr. Belito believed that he had <br />instructed, them to express their concerns about traffic, the flooding situation, and asked why he had <br />7
