Mr. Mauuing stated that at the previous meetings the proposals required either <br />variances or rezoning, so the advice was to work with the developer because he would need their help <br />to get these variances. Now they do not need the residents help, they have proposed a plan that is in <br />compliance. He pointed to the red line on the plan presented previously showing what required <br />rezoning. Mr. Belito asked why taking the red line away would alleviate the problems of traffic and <br />flooding. He stated that if any of his grandchildren got hurt he would come after him personally. Mr. <br />Mauuing stated as far as the plotting is concerned this is right, the instructions were to get with <br />Whitlatch and see what could be done as far as a compromise. However, Whitlatch took it upon <br />themselves to comply with everything. Councilman Miller believed that the instructions from Mr. <br />Tallon were that the neighbors should get together and set up their list of priorities and stop sending <br />mixed signals to the planuing commission and that is exactly what the neighbors have done. He asked <br />Assistant Law Director Dubelko if proper notification had been given to the neighbors that a new plan <br />had been submitted. He stated that the new plan was submitted to city hall on Friday, and he believed <br />that the plamiing commission did not get it until this evening. He asked that this proposal be tabled <br />and brought back later so that the residents who would be most deeply affected by this would have an <br />opportunity to review these plans, to make certain that the plans do, in fact, conform to code. He <br />stated that the fact that the developers brought this in on a Friday did not give the neighbors, who are <br />very well organized, a chance to review or respond to the plan. He also questioned if Maple Ridge (he <br />stated W. 231) would be a wide enough street to properly tie into another street since it is his <br />understanding that it needs to be a 60 foot wide street and it is possible that he may not even be able <br />to come off of West 231st Street. Regardiug notification, W. Dubelko, stated that if it were <br />determined that the notification list had changed because of the changed proposal the proposal could <br />be tabled until proper notification is sent. But even if the notification was proper, because of the late <br />date of the submission, the planning commission could table the proposal until the next meeting. It <br />was determined that the notification list had probably not been changed with the new proposal. Mr. <br />Miller asked that, considering that that the number of units had been changed in the new plan, because <br />only one resident had had a chance to look at the plan, and because the commission is obligated to <br />review the plan with a little deeper thought than they had had a chance to do this evening, the <br />proposal be tabled. T. Manuing moved that the Whitlatch and Company Subdivision - Prelimiuary <br />Plau. The proposal is to subdivide permanent parcel nos. 231-14-1,2, 3, and 4, located on the north <br />side of Lorain Road between Clague Road and West 231 Street, and abutting the east terminal ends of <br />Sharon and Woodview Drives, into fifty six (56) "C" Residence, Single lots plus remnant commercial <br />property fronting on Lorain Road. The proposed residential subdivision extends south into the existing <br />commercial (Retail Business, General) zone. Tabled at planning commission meeting of March 14, <br />1995 since this plan was for 561ots and the plau that was submitted tonight calls for a decision on 48 <br />lots and for that reason it is to be tabled until the next meeting. The motion was seconded by T. <br />Brennan, and unanimously approved. Mr. Whitlatch stated that he was disappointed and advised that <br />next week neither he nor Mr. Basalla will be present, but their general cou.nsel will. He noted there is a <br />U. S. constitution and it does overrule mob rule. The neighbors protested and a resident, speaking <br />from the audience, stated that two weeks ago Mr. Whitlatch had told them that he would not have an <br />entrance on Lorain Road and that he would have kids ruuning through their neighborhood. The <br />neighbor contended that Mr. Whitlatch was the mob. Mr. Miller asked that these comment be put on <br />the record because they were an example of Mr. Whitlatch coming in and bullying the neighbors. He <br />asked Mr. Whitlatch to stop being a bully and stated that this was a city of residents. Another resident <br />stated that two weeks ago, after he lost, Mr. Whitlatch threatened that he would have kids and tiaffic <br />8
