Chairman Tallon advised that because this is not on the property that is being drained, <br />it presents a problem for the Commission, and because there has been no decision, he has asked Mr. Coury <br />to be prepared to do undergrou.nd retention on his own property. Mayor Boyle stated that other solutions <br />to the Barton Road problems would be to put ditches or retention on their properiy at their cost. This is <br />one way to approach the problem without hurting anyone. Mr. Manning questioned who would maintain <br />the retention and who would be liable. Mayor Boyle stated that these issues have not been decided as yet, <br />neither has it been determined if a fence will be installed, but these plans will come back to the <br />commission. He stated that while the city was planuiug to construct this themselves, they did a lot of <br />investigating and many of the people involved have become experts in what is needed for senior housing <br />which is very different from normal multi-family developments. He did believe that it would be easier to <br />get financing if there were more units. He also stated that Mr. Coury has agreed that North Olmsted <br />residents, parents and in-laws of residents will get first priority. According to studies, most of the residents <br />will probably come from North Olmsted. Mr. Kaczmar clarified for Mr. Tallon that the total height of the <br />building would be about 58 foot, 8 inches. Mr. Coury estimated that the rental costs including utilities <br />except telephone at $700.00 for a one bedroom, $750.00 for a 2 bedroom; and about $1,500 a month <br />including meals and service in the assisted liviug, units. Nu.rsing home fees will be set by Federal standards. <br />There will be a nurse consultant in the assisted living area, but not on a 24 hour basis. If there is a medical <br />problem the persons personal physician is called or, if needed, they might call 911. They have a zero <br />vacancy rate in their other communities. There would be 153 people in the independent living area and 50 <br />in the assisted living. The members discussed the variances needed with Mr. Conway and among <br />themselves. Mr. Herbster was concerned that granting the height variance will set a precedent and others <br />will want five stories. Chairman Tallon explained that he was going to make two motions, one for the <br />variance to be reviewed by the board of zoning appeals and another regarding the variances that can be <br />granted by Planning Coinuussion, but he cautioned that they were not going to consider the shared parking <br />on St. Clarence's property, that can be discussed later. <br />Motion: R. Tallon moved to refer the proposal for Castle Pines located on property currently shown at <br />30338 and 30374 Lorain Road to construct a senior citizen complex with apartments, assisted living u.nits, <br />and a nursing home facility, to the board of zoning appeals with the recommendation that the variance to <br />have a fifth floor and a variance for 62 parking spaces (this variance does not include the shared parking <br />spaces on the St. Clarence property), seconded by T. Brennan. Roll call on motion: Tallon, Brennan, <br />Koeth, Mauuing and O'Rourke, yes. Mr. Herbster, no. Motion carried. <br />Motion: R. Tallon moved to grant the 85 foot rear setback variance since this is within the authority of <br />the commission to negotiate, and the commission believes that this can be granted on the condition that a <br />substantial buffer is built along the back and west corners of the properiy to sufficiently buffer the view <br />from the residential areas, where this abuts residential properties. The commission has no problem with <br />granting the 10 foot parking setback variance along the west side of the property, but requests that some <br />type of landscaping be put in there to create a bu.ffer zone. Also the commission is vvilling to grant the 23 <br />and 13 foot side yard setback variances, the size of which is dependent on the height of the building, with <br />the same condition that appropriate landscaping is installed. These variance will be given by the planning <br />commission when the developer returns with an acceptable proposal that shows the landscaping buffer, but <br />until that time these variances will not be granted. Failure by the developer to satisfy the planning <br />commission could cause denial of the setback reductions and require an additional appeal to the board of <br />zoning appeals. Regarding the retention, the commission will make a decision after the meeting with the <br />Metro Parks and the administration takes place, which we hope is favorable for everyone, and at that time <br />we can look into the site proposaL We also would like to send the plans on to architectural review board, <br />6
