Mr. Wyinau, trustee of the corporation, presented the plat and explained that the proposal was <br />approved previously, but they have to consolidate the lots into one. The members had no questions. R. <br />Koeth moved to approve the Christian Meeting Corporation Consolidation Plat be approved for a <br />proposal to combine permauent parcel nos. 237-23-19, 20, 21, and 22, located at the southeast corner <br />area of Brookpark and Clague Road, and the site of the proposed and approved Christian Meeting <br />Corporation Chapel, into one (1) parceL The motion was seconded by A. Manuing and u.nanimously <br />approved. <br />2) Wells Consolidation Plat. <br />The proposal is to combine permauent parcel nos. 235-14-7 and 8, located on the ease side of Bums <br />Road, south ofMidvale Avenue, into one (1) parcel: Zoning is `B" Residence, Single entirely and the <br />proposal conforms to Zoning Code Requirements for_frontage and area. <br />Mr. and Mrs. Wells presented the proposal and advised that they are combining the two lots is in order <br />to build a replacement house on the property, and to bring the existing garage into confonnance since <br />it was originally built with a permit from the city on a separate lot. The existing house will be <br />demolished after the new house is built. Councilman Nashar asked if Mr. Wells had any specific dates <br />for what he was doing. He explained that he had had many complaints from residents of Burns Road <br />about junk and debris in the front yard and that the radio tower in the rear which is in deplorable <br />condition and should be removed. He would like to see the plans for the proposed home. He has heard <br />that Mr. Wells has made many promises, but all he has done is to pick up the debris around his house. <br />He maintained that the neighbors have tried to help the Wells in order to improve the appearance of <br />the property, and he is opposed to joining the lots because of their condition. Mr. Mauning advised <br />that this is just a proposal to join the two parcels and the city or the Board of Health would have to <br />address the items that he mentioned. Mr. Nashar believed that the Health Department had investigated <br />and he again stated that he would like the Wells to give up the radio tower. Mr. Dorony, a neighbor, <br />explained that they have similar concerns. He advised that there were easements on the property which <br />would make it undesirable to build a new home; a 54 inch storm sewer which runs through the <br />property and possibly a 30 inch sanitary sewer in the same location: Both pipes run adjacent to his <br />dwelling. He is concerned about building a home so close to the sewers since there could be a problem <br />with maintaining the sewers. He believed that the location of the sewers and the adjacent home would <br />limit the size of the house that could be built there, and assumed that there would be a specified <br />distance between the house and the sewers and thought that the feasibility of building any thing on the <br />lot should be discussed first, before the lot is assembled. He presented a drawing showing the location <br />of the sewers. He believed that if a home was built there and subsequently damaged because of the <br />sewers, the city would have some liability. Assistant City Engineer McDermott advised that the <br />Engineering Department would not permit a home to be built so that it encroached or endangered a <br />sewer, either the home would have to be positioned so that it was not within the easement, or the <br />sewers would have to be relocated and the easement vacated at the owners' expense. The Engineering <br />Department cannot make a determination or any commitment until the plans are submitted. The plans <br />will have to be evaluated in light the existing sewers and easements. The plat shows a storm sewer <br />easement, but does not show a sanitary easement, so this will be verified. He believed that there would <br />be room to build a house without encroaching on the easement. The two lots will be 85 feet after the <br />property is combined. The members discussed the proposal. Mr. Wells presented a drawing showing <br />where the sewer easement was located and indicated that there would be enough room for a 28 foot <br />wide house. Mr. Wells discussed this with the members, but the discussion was not audible. T. <br />Brennan moved to accept Wells Consolidation Plat, a proposal is to combine permanent parcel nos. <br />3
