V <br />.i <br />trespassing tluougli their property. Mr. Patel advised that he was plauning to install a 10 foot lugli <br />fence along the east parkuig lot. Mr. Thomas, a resident, suggested that the commission require a bond <br />to insure that they install the retention and paving since previously they got temporary permits to use <br />the front parking on the gravel with a promise of paving in the suinmer, but never paved it. Mrs. <br />Morano stated that all the businesses in this location have caused problems. Her husband gets up a 3:30 <br />for work, and the noise keeps him awake unti12:30 a.m. 5he does not want this business there. Mr. <br />Patel explained that the property would be drained, and with the mound, no water should go onto their <br />property. He will be putting up roof top equipment which is smaller than what was there, and if <br />necessary they could shield it_ He repeated that there will be no live music, the back doors Will remain <br />closed, and they will not take out the garbage in the middle of the night. He offered to reduce the <br />parking to whatever the city would want. Mr. Tallon requested that he laudbank the seven parking <br />spaces in the back (circled number 3 and 4); the back four parking spaces on the east side (circled <br />number 12); one parallel parking space on the side of the building next to the dumpster, (circled number <br />1); 16 spaces in the front (circled number 5 and 7); and eliminate the drive to the back and the spaces <br />adjacent to it. He was also advised to enclose the dumpster and relocate so it will not be visible from' <br />Lorain Road and also to shield the roof top units from the neighbors' property. Before he returns he <br />must eliminate the light that is shiving into the neighbors homes. Mr. Morano advised that 1Vdr. Patel had <br />never discussed lus plans with the residents, and, if he had, it might have saved soine of this discussion. <br />Mr. Tallon stated that this is always a good idea. IVir. Patel had no problem with the suggested changes, <br />aud further advised that he would repair the fence. 1VIrs. Massingill, a resident, asked if the business <br />would have to be open seven days a week, and pointed out that the foriner business was only open on <br />weekends, and it still caused a lot of problems. She believed that 7 days a week was excessive. Assistant <br />Law Director I3ubelko advised that this would not be up to the commission, because it is not a matter <br />of the zoning codes. If the city changed the business regulations to limit hours, they would have to limit <br />the hours far all business. The couucil would have to change the business regulations, and that could <br />still be a problem, because establishments which serve alcohol are regulated by the State. Mr. Patel <br />advised her that this would be an upscale restaurant, and would not have people weaxing tauk tops and <br />cut offjeans. Since it would cost $7.00 an hour to play billiards, it would discourage young people from <br />playing. He further advised Mrs. O'Rourke that the motor home in the driveway was a construction <br />office, and would not stay there. Mr. Hamdan asked if the internal baffling that had been required of the <br />previous owners was still existing or would it be installed. Mr. Patel responded that they would not <br />have any loud music or bands and all the windows will have blinds, etc. Mr. Hamdan stated that there <br />had been issues with noise even when there was no music. If the ba$ling has been removed, he tliinlcs it <br />should be addressed. Mr. Hamdan asked if the parking could be moved up front so some of the trees <br />could be saved. This will be sent to the forester for his iuput on the trees. The neighbors were advised <br />that no further notices would be sent if tlus were continued to a specific date. 1VIr. Dubelko advised that <br />a liquor license could be removed if there was a lustory of problems. It was noted that tlus had not been <br />done at this location, possibly because the restaurants went out of business before anything could be <br />done. Since Mr. Patel has to re-open by January 15, 1995 to keep his liquor license, it was decided that <br />this could return on Januaiy 9th. Mr. Conway clarified that there is some asphalt there, and if he opeus <br />up before he gets lus approvals, he would have to limit his seating so that the existing parking conforms. <br />He stated that they were limited to about 60 seats by a previous court order. A performance bond could <br />be requued with the approvals. Mr. Patel will discuss the revised plans with Mr. Conway. R. Tallon <br />inoved to continue the Alexander's, 30850 Lorain Road, proposal for a review of site plan until the next <br />meeting on January 9, 1996, seconded by R Koeth, and unanimously approved. <br />IV.
