4. Larrv Decaire 5357 Porter Road: ` <br />Request for variance (1123.12). Request 42 squaxe foot area variance; request 1 foot height variance; <br />and request 4 foot location variance from rear lot line to replace existing garage and shed. Violation <br />of Ord. 90-125, Sections 1135.02(c)(1) and (c)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was admivistered to Mr. <br />K. Decaire, the applicant's son. The members agreed that the garage would be an improvement. J. <br />Maloney moved to grant the request of Larry Decaire, 5357 Porter Road for a 42 square foot area <br />variance; a 1 foot height variance; and a 4 foot location variance from rear lot line to replace existing <br />garage and shed. -Violation of Ord. 90-125, Sections 113 5.02(c)(1) and (c)(2). The motion was <br />seconded by T. Kobema and unani.mously approved. Variances granted. <br />5. Main Street Cafe (formerly Ice Cream Parlor) 27045 Lorain Road. - <br />Request for variance (1123.12). Request 8 foot setback variance to.change height of ground sign to <br />make it a pylon sign. Violation of Ord. 90-125, Section 1163.12(b). <br />Variances granted on May 18, 1994 and September 7, 1994. <br />Heard by Architectural Review Board May 18, 1994 'and March 22, 1994. <br />Chairman Gomersall called all interested parties before the board. The oath was admivistered to Mr. <br />W. Benik, who eacplained that the ground sign was installed, but he wanted to change it to a pylon <br />sign. Mr. Gomersall noted that the Architectural Review Board had problems with a ground sign, and <br />he recalled that when the first variance was granted, the board had discussed the visibility problems at <br />length. He believed that raising it 3 feet would make those problems worse. Mr. Benik noted that, <br />the entrance sign that was required by the Planning Commission blocks the view of the ground sign <br />driving eastbound on Lorain Road. He also pointed out that the signal box and pole for the traffic <br />light for Toy's R. Us were installed on his property improperly since they should have been on city <br />right of way, and this also restricts the view of his sign. Mr. Gomersall stated that he had no problem <br />seeing it when coming from the east. Mr. Maloney believed that there was an adequate view of the <br />sign going either east or west, but is concerned that if the sign were raised, it might block the view of <br />someone turning off Lorain Road if there was a car on the drive. Mr. Benik doubted this and stated <br />that it would not be a d.irect view and a car traveling west on the driveway would not be in the path of <br />a car turning in. Mr. Gomersall noted that this was discussed at length at the Plauning Comuussion <br />and when this board granted the variance it was agreed that a ground sign would be best. Mr. <br />Conway clarified that any non conforming sign would have to come back before the board in January <br />of 1998, not just pole signs. He noted that there is no ability to move the sign further back on the <br />property, and the board was concerned about visibility when they.grauted the origiual variance. Ms. <br />Boyle agreed that the board had spent a lot of time on this when the ground sign had been origin.ally <br />approved. J. Maloney moved, to grant the request of Main Street Cafe, 27045 Lorain Road, for an 8 <br />foot setback variance to change the height of a grou.nd sign to make it a pylon sign. Violation of Ord. <br />90-125, Section 1163.12(b). The motion was seconded by T. Koberna. Roll call on motion: Maloney, <br />Koberna, Boyle, and Gomersall, no. Motion failed to pass. Variance denied. Mr. Benik stated that the <br />board was wrong, and if they had stopped in he would have driven his car around to test the <br />situation. <br />3
