Chairmau Goinersall called all interested parties before the board. The oath was administered to Mr. <br />Hamdan. Mr. Gomersall advised that Mr. Hamden had stated that he had misunderstood what he had <br />been told and had measured a neighbor's shed wluch had been iustalled under a previous code. No <br />neighbors were present. Mr. Gomersall had no problem with the request. Mr. Maloney stated that he had <br />talked to one neighbor who had uo problein with the location. T. Koberna moved to grant a request to <br />Ali Hamdau, 23521 Stoneybrook Drive for a 3 foot rear yard variance for location of shed (already <br />installed). Violation of Ord. 90-125, Section 1135.02(D)(4). The motion was seconded by J. Maloney <br />aud unanimously approved. Variance granted. <br />7. Samir Ewida, 7155 Barton Road. <br />Request for variance (1123.12). Request variance to have a six foot solid fence in side yard of a corner <br />lot aud 23 foot variance for locatiou of fence wluch will encroach into the required 50 foot front setback <br />of the abuttiug. Violation of Ord. 90-125, Section 1135.02. <br />Chairman Gomersall called all iuterested parties before the board. The oath was administered to Mr. <br />Ewida who explained that he was on a corner lot and he wanted the fence for privacy and safety for his <br />children. Mr. Gomersall advised that lus neighbor did not realize that the fence was to be six feet high. <br />Mr. Ewida explained that the fence would be the same as his neighbor's across the street. He presented a <br />note from Mr. Abed, the adjacent neighbor, stating that he had given permission for the fence, but Mr. <br />Gomersall stated that tlus was the ueighbor wlio did not realize how high the fence would be. He believed <br />that a 4 foot lugh fence would not look so much like a fortress. It was clarified that the fence would be 23 <br />feet along the neighbor's fiont setback. It was uoted that the fence would be on the common property <br />line, but Building Commissioner Conway advised that that was not a code issue. It was suggested thai <br />1VIr. Ewida could move the fence back 50 foot so he would not need a variance. After some discussion <br />W. Ewida agreed to have a 4 foot high fence along the neighbor's front setback with a 6 foot fence <br />beyond it and along the interior 1'vie. This would require an 18 inch height variance for the portion in the <br />front setback. Mr. Conway suggested that the fence be graduated somewhat, either curved or at an angle, <br />in a 5 to 6 foot area, where the 6 foot fence meets the 4 foot fence to make a better looking transition. <br />He clarified that the fence adjaceut to the ueighbor's front setback should be a 4 foot fence except for a 5 <br />to 6 foot area where the two fences meet. T. Koberna moved to grant the request of Samir Ewida, 7155 <br />Barton Road, for an agreed inodified request to have a 4 foot solid fence in a side yard of a comer lot and <br />a 23 foot vaiiance for location of fence which will encroach into the required 50 foot front setback of the <br />abutting home. Also with the note that at the transition point at the 23 foot setback line allow the fence to <br />go from 6 feet to 4 feet in a 5 to 6 foot area. Violation of Ord. 90-125, Section 1135.02. The motion <br />was seconded by R. Goinersall, and unauimously approved. Variance granted. <br />8. Richard LaVelle, 25004 Carey Lane. . <br />Request for variance (1123.12). Request 350 square foot variance for garage area to add storage area <br />onto existing attached garage. Violatiou of Ord. 90-125, Section 1135.02(c)(3). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />LaVelle aud Mr. Janovsky, lus builder. It was clarified that the storage area would be built onto the <br />existiug garage. M. Boyle moved to grant the request of Richard LaVelle, 25004 Carey Lane, for a 350 <br />square foot variance for garage area to add storage area onto existing attached garage. Violation of Ord. <br />90-125, Sectiou 1135.02(c)(3). The uzotion was secouded by J. Maloney, and unanimously approved <br />Vaiiauce grauted. <br />4
