., ../ , _ <br />9. Robert Jackson, 23884 Gessner Rd. <br />Request for variance (1123.12). Request 5 foot variance for total side yards and 5 foot variance to install <br />a driveway in a side yard less than 15 feet wide in order to replace exdsting attached garage with addition <br />and to construct a detached garage on property. Violation of Ord. 90-125, Section 1135.07(a). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Jackson, and 1VIr. Hess. It was clarified that the present attached garage would be converted into living <br />area and a detached garage with a drive to it would be constructed. The members had no problem with <br />the request. T. Koberna moved to grant tlie request of Robert Jackson, 234 Gessner Road for a 5 foot <br />variance for total side yards and a 5 foot variauce to install a driveway in a side yard less than 15 feet <br />wide in order to replacQ eacistiug attached garage with an addition and to construct a detached garage on <br />property. Violation of Ord. 90-125, Section 1135.07(a). The motiou was seconded by J. Maloney, and <br />unanunously approved. Variauces granted. <br />10. Luigi Veutiua, 5678 Decker Rd. <br />Request for variance (1123.12). Request 4 foot variance for distance between dwelling and proposed <br />detached garage; request 5 foot side setback variance and 8 foot rear setback variance for location of <br />garage. Violation of Ord. 90-125, Section 1135.02(c)(2). Note: adjacent 20 foot wide lot is ovvued by <br />, applicant, but has uever been combined with property on wluch house is located. <br />Chairmau Goinersall called all interested parties before the board. The oath was administered to Mr. <br />Ventura, who advised that he knew that he would have to install a fire wall on the wall close to the <br />house. Building Commissioner Conway advised that tlus would be right ou the property line and there <br />would be no room for maintenance or overhangs, etc. and the wall adjacent to the liue would probably <br />have to be a fire wall also. He further stated that the house was built over a property line so tecluucally <br />the garage will be on a separate lot. This would be the time to clear up that situation. The members <br />agreed that the garage has to be set back at least 2 feet from the property line for mauitenance. Mr. <br />Ventura stated that he would be williug to install concrete between the garage and the property line to <br />eliminate weeds, etc. Mr. Conway would like the Eugiueeriug Department to check tlus out because there <br />migbt be a drainage problem, aud he would have to submit something to the Engineering Department <br />showing that he would maintain all the water ou his own property. 1V1r. Ventura was not aware that there <br />were two separate parcels and he was advised that the title company might be responsible since they did <br />uot uotify lum of it. Law Du-ector Gareau advised that the legal description might encompass both lots <br />and if he has one parcel number, the lots could have been combiued by the county. Mr. Veutura will <br />check tlus out. Mr. Goinersall advised that if the lots were not combined, it would have to be done. Mr. <br />Gomersall questioued if the variance for tlie distance between the house and garage should be larger since <br />the garage is to be moved over, but W. Ventura did not tluvk so. ,Mr. Conway stated it was measured on <br />an angle and inight vaiy a foot or so. J. Maloney moved to grant to Luigi Ventura, 5678 Decker Road, au <br />agreed inodified request for a 4 foot variance for distance between dwelling and proposed detached <br />garage; a 3 foot side setback variance and a 6 foot rear setback variance for location of garage. Violation <br />of Ord. 90-125, Section 1134.02(c)(2). The variances are granted on the condition that the garage will <br />have fireproofed walls aud draivage as p"rescribed by the Engineering Department and that the applicant <br />will work to have the lots comUuied iuto one parcel, if not already done.. The motion was seconded by R. <br />Gomersall, and uuaiumously approved. Variance granted. <br />5
