, <br />Assistant City Engineer McDermott explained this is actually part of the preluninary plan that was <br />approved at the last meeting. Although it is not usually done in this order, he believes there is really <br />nothing wrong with it. He stated they are addressing planuiug commission's previous requests by <br />attaching the two Christuia.n lots and then splitting the two lots that front on Gessner Road and adding a <br />portion of Mr. Boutnan's adjacent lot. He clarified these changes will have to be incorporated on the <br />plan that was previously approved. Although this proposal conforms to code for both frontage and <br />depth for the lot, a side line variance will be needed for the existing house. He advised there would be a <br />total side lines of approximately 11 feet for the .house and 15 feet is required by code. Mr. Bouman <br />arrived at this time. He explained he had excess land on the east side of his lot wluch he planned to sell <br />to Mr. Hammerschmidt for the eventual development of two 60' buildable lots. Mr. Bouman stated that <br />Mr. Hammerschmidt has agreed to keep 15 feet between his foundation and the that of the new home. <br />He was aware that the distance between his house, and his new lot line does not equal the 15 feet total <br />side yards that code requires and there is approximately 6 feet between his foundation and the proposed <br />new lot line, thus a variance will be required. Mr. Bouman clarified, according to his records, there is <br />approximately 5.5 feet between his property and his daughter's wluch is adjaceut property ou the west <br />(the plan shows 4.33). Mr. McDermott explained that his department does not have a record on this and <br />the number must have come from Mr. Bouman's engineer. According to Mr. Bouiuan's measureineuts <br />there is approximately 15 foot, 1 inch distance between the his house and his daughter's with 5.5 feet of <br />this side yard is on his property and 9.5 feet is on his daughter's. Mr. Brennan felt that Mr. Bouman is <br />creating a hardship for himselt because his once conforming house now becomes non-conforming. Mr. <br />Bouman stated he is selling this strip of his property because, he did not want the 80 year old home to <br />the north of his property moved next door. Mr. Brennan claimed that, if this lot were ever sold, a new <br />owner would have to go for a variance if he wanted to add auything on. He reiterated that they have <br />taken a conforming house, sold off a portion of the lot, and created a non-conforming house thus <br />creating a hardship for any future resident of that parcel. N1r. Tallon explained to Mr. Hammersclunidt, <br />the builder who was in the audience, that the widest he could build the house would be 45 feet, which <br />includes the garage in order to have 15 feet of separation between foundations. Mr. Hammerschmidt <br />responded that he can even reduce the size to 40 feet wide, in the past he has built houses as big as 2400 <br />square feet on a 59 foot wide lot. <br />Chairman Tallon moved to approve the proposal of the Hammerschmidt Builders, Ann F. Christmau, <br />and Joseph Bouman Lot Split and Assembly Plat, a proposal to assemble (combine) the south portion <br />of permanent parcel no. 231-26-89, currently landlocked, with perinanent parcel no. 231-26-18 as <br />requested by planniug commission as part ofthe Beaumont Place approval. The proposal also includes a <br />land split of permauent parcel no. 231-26-088, a strip of which is to be joined to originally proposed <br />sublot 19 of Beaumont Place, which is now proposed to be split into two (2) buildable lots fronting on <br />Gessner Road; the remaining portion of parcel 231-26-088 will require a variance. Zoning is `C'- <br />Residence, Single entirely and the proposal. conforms to Zoning Code requirements for area aud <br />frontage. This proposal will be referred to the board of zoning appeals with the recommendation for <br />approval. The motion was seconded by T. Brennan and unanimously approved. W.
