R. Tallon moved to accept the Seaman's Furniture Consolidation Plat, the proposal is to <br />combine periuanent parcel nos. 236-06-16 and 236-08-01 into one (1) parcel. Location is <br />Lorain Road (24869) west of Columbia Road. Zoning is Retail Business, General, entirely and <br />the proposal conforms to area and frontage requirements. The motion was seconded by R. <br />Koeth, and unanimously approved. <br />2) Beauinont Place Subdivision: Plat and Improvement Plans. <br />The proposal is for eighteen (18) residential lots from originally platted permanent parcel nos. <br />231-26-12, 231-26-15, and part of 231-26-89. Location is north of Gessner Road, west of <br />Beaumout Drive. Zoning is "C" Residence, Single Family, entirely, and all proposed sublots <br />conform to area and frontage requirements. Preliminary plans for the proposed subdivision were <br />approved by planning commission ou 5/28/96, with additional changes approved ou 6/25/96. <br />Mr. Hammerschmidt, the builder, and Mr. Resar, engineer, presented the plat. It was clarified <br />that there would be u.nderground retention which would be in the perimeter of the rear yards. <br />City Engineer Deiclunauu explained that the retention would drain into the Coe lateral wluch is <br />immediately to the west of the site. Mr. Herbster asked what they were going to do with the <br />sidewalk that went right to one of the back yards. T1us was vacated to a home owner, and it <br />would be up to thein to eliminate the sidewalk. Mr. Deiclunann advised that some access <br />easemeuts have been added to the plat in order for the city to be able to get in and clean the <br />sewers. It was clarified that tlus is necessary in case there is a problein with the undergroiuid <br />system and that older systevis did not have uuderground retention. He clarified where the <br />easements would be since the engineering department only needed access to certain areas and <br />also noted that there are individual swales, but there were collectors on each lot. <br />R. Tallon moved to approve the Beaumont Place Subdivision: Plat and Improvement Plaus, the <br />proposal for eighteen (18) residential lots from origiually platted permauent parcel nos. 231-26- <br />12, 231-26-15, and part of 231-26-89 with the inclusion of the additional access easements that <br />are noted on the plat. COMIVIUNICATIONS: <br />Ordinance 96-161 <br />This is an ordinance amending Sections 1122.13 and 1122.14 of the North Olmsted Zouiug <br />Code requiring councilmatic review on any use variance granted by board of zoning appeals. <br />Assistant Law Director Dubelko explained that initially there was an ordinance to ainend the <br />charter to prolubit the board of zoning appeals froin granting use variances, wluch the Mayor <br />tlueatened to veto, and a compromise was reached so that council could review any use <br />variance. He clarified that tlus only applied to a use variance, uot an area variance and it does <br />uot apply to any use variance that board of zouing appeals denies. This is similar to other <br />council approvals required for commercial special permits and rulings. R. Tallon moved to <br />recommeud to council that Ordinance 96-161 be approved, seconded by A. Manning, and <br />uuanimously approved. <br />7
