Tlie members discussed a <br />perforina.nce bond, and Mr. Conway advised that this would only be needed in the event that he was <br />allowed to seat more customers than his parking would permit. Mr. Conway will discuss this with the <br />Assistant Law Director, and it can be decided at the next meeting. Mr. Thomas, a resident and a former <br />plauning commission member, noted several items: some of the areas marked existing planting areas are <br />gravel; the residents asked that the rear landscape area and part of the west landscape area be mounded. <br />He pointed out that half of the building would be pool tables and doubted that there would be 240 seats. <br />He also doubted that this would be a upscale restaurant as it was described and believed that this is a <br />pool hall which would attract young men who like to driuk. He would like all 12 parking spaces on the <br />west side landbanked. After a snow storm there was a 5 foot mound of snow wluch effectively shielded <br />the construction debris which is strewn around the property. He also requested that the H.V.A.C. <br />equipment on the roof be shielded from the residential area; that there be a mound in the back to keep <br />customers from this establislunent off the residential property; that the existing fence be improved; and <br />the existing landscaping redone. He pointed out the plans stated to maintain existing rail road ties, but <br />most of them were rotted. He believed that the eastern most parking area was unusable as shown and <br />would like to see diagonal parking there as well as the removal of parking in the back. He stated that <br />this business has been before the commission several times in the last 12 years, and the last several <br />developers were permitted to open without completing all the improvements. He urged that au <br />occupaucy permit not be granted, until the plans are completed. He asked the members to drive through <br />the site and see what is there. He further wondered what other establishment the developer owned. Dr. <br />Patel responded that they have conected all the problems on the inside of the restaurant, electric, <br />sewers, etc., and eveiytliing was done according to the code. He advised that he owned BW-3 in North <br />Ridgeville, Sly Fox on Crreat Northern Boulevard, and formerly owned Tags in Fairview Park. He <br />agreed that the rail road ties were not in good condition, but he pointed out that he had not owned this <br />property previously. He advised that the existing heating and air conditioning unit on the roof could <br />have been repaired, but since it was rusted, he replaced it with a smaller one. He wants to do the <br />parking right, and does not want people parking on the grass or in the neighborhood. The 5 foot mound <br />and landscaping are on the plans. Mr. Thomas reiterated that the neighbors did not believe that he <br />needed as many parking spaces as shown and asked that he consider landbavkiug them; neither do they <br />believe that they are going to have 240 seats since half of the building is taken up with pool tables. Dr. <br />Patel stated that, if they did not have enough parking these same people would complain if his <br />customers parked on their streets. Mr. Morano, a resident right behind the property, agreed with Mr. <br />Thomas and noted that at the last meeting tlie commission suggested that the developer talk with the <br />neighbors about what is going on. He has not attempted to do this. He believed that Dr. Patel will be au <br />absentee landlord, he has invested his money, will hire a manager, and the neighbors will never see him <br />again so he did not care how the neighbors feel. Mr. Thomas stated that they are not asking that the <br />property not be developed, they are requesting that the city protect the residents from noise, nuisance, <br />and invasion of privacy with a privacy mound and area around the development for protection. He <br />stated that he had been following this parcel for 12 years, and nothing was done to prevent problems. <br />Mr. Tallon pointed out that Mr. Patel did not own the property then. Mr. Thomas asked that the city <br />establish guidelines for parking and buffers to prevent future problems. Mr. Conway did not think that <br />the establishment will have 240 seats either, and needs to see a seating layout, both to establish parking <br />and check egress. No variauces will be required under the revised plan. Dr. Patel was advised that tlus <br />proposal will be forwarded to the architectural review board and he will have to submit a seating plan; a <br />photometric plan; the revised parking plan with the 90 degree parkuig; a brick enclosure around the <br />4
