Chairman Gomersall called all interested parties before the board. The oath was admiiustered to Mr. <br />Nader who explaiued that he wanted to put the unit behind a 4 foot lugh brick screen wall betweeu <br />his house and a neighbors. He had a letter from the neighbor saying that he had no objection. He <br />maintained that he could not put it on the back side of the wall, because it would be right next to lus <br />patio and eventually he wants to put a new stone patio in the back. Apparently, the inspector <br />misunderstood and thought he was goiug to put in a deck. Mr. Gomersall believed that it was too <br />close to the neighbor and a new neighbor might object. Ms. Boyle noted that he purposely built the <br />wall to conceal the air conditioner. Mr. Koberna stated that if the homeowner wanted it there, and <br />the neighbor did not object, he could see no reason not to grant the variance. The members discussed <br />various locations, but no compromise could be reached. R. Gomersall moved to grant to J. Nader, <br />23506 Carriage Lane, 4 foot side yard variance to install air conditioning uuit at side of house (5 foot <br />setback between house and property line) to allow construction of a deck. Violation of Ord. 90- <br />125, Section 1135.07. Please note: Section 1355.03 of the Building Code requires permission of <br />Building Commissioner to place unit in side setback. The motion was seconded by T. Kobema. Roll <br />call on motion: Koberna, Boyle, and Furper, yes. Mr. Gomersall and Mr. Maloney, no. Motion <br />carried. Variance granted. <br />11. William Varga, 4522 Columbia Rd. <br />Request for variance (1123.12). Request 280 square foot variance for shed exceeding the 200 square <br />foot limit; also, request 4 foot 5 inch height variance. Violation of Ord. 90-125, Section <br />1135.02(D)(1) and 1135.02(D)(3). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Varga, who explained that he did wood working and he needed room for the tools and there would <br />be storage on the second floor. He advised that this is a hobby, he is not mmning a business. He also <br />checked with most of his neighbors. No neighbors were present. He presented a picture of the shed <br />which is a inanufactured building. He advised that this would be directly opposite lus neighbor's <br />garage and is about the same size. Mr. Puxper noted that it is a big back yard, but this is still a big <br />building. It was suggested that he use the 16 by 20 shed, but Mr. Varga maintained that would not be <br />as high and he needs the storage room. Law Director Gareau advised that a person doing wood <br />working does need rooin and he built a 20 by 20 addition to lus house for his woodwarking shop. <br />The members agreed, noting that it is in line with the neighbor's garage aud the trees break it up a <br />bit. W. Purper moved to grant the request of William Varga, 4522 Columbia Road, for a 280 square <br />foot variance for shed exceeding the 200 square foot limit; also, request 4 foot 5 inch height <br />_variance.,Violation of Ord. 90-125, Section 1135.02(D)(1) and 1135.02(D)(3). The motion was -- <br />seconded by T. Koberna, and uuaniiuously approved. Variances granted. <br />9. American Commodore Tuxedo, 26400 Lorain Road. (Heard at tlus point). <br />Request for variance (1123.12). Request 20.2 square foot variance for excess sign area; request <br />variance for second wall sign; and request variance to install individual tenaut sign on a nou- <br />conforming pole sigu. Violation of Ord. 90-125, Sectious 1163.11(a); 1163.12(a); and 1163.12(h). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Shaner, who explained that the sign was ouly partially up. He clarified that the insert for the pole sigu <br />was the exact size as the ones that are there. Mr. Gomersall stated that the sigu was subdued. T. <br />Kobema moved to graut the request for Americau Commodore Tuxedo, 26400 Lorain Road, for a <br />20.2 square foot variance for excess sign area; request variance for second wall sigu; and request <br />variance to install individual tenaut sign on a non-conforming pole sign.
