Mr. Maloney noted that this sign is only two <br />feet off the ground and will be a safety hazard because it is right at the main driveway. The members <br />agreed. After some discussion, it was decided that there was no location where this sign would not be a <br />problem; but a modified pole sign that was at least 8 feet offthe ground could be installed in the same <br />location and would not be a problem. Mr. Huxon agreed to a modified request. Law Director Gareau <br />advised that this is a location where a ground or pylon sign is not feasble, and it should be stipulated <br />that it will not have to return for a variance in 1998. It was agreed that the mod.ified pole sign could be <br />6 foot square, but should be 8 foot off the ground for visibility and could have either one or two poles, <br />but could be no higher than 14 feet. It was suggested that they remove some of the framing to make <br />the sign lower. J. Maloney moved to grant to Ethan Allen Home Interiors, 26125-27 Lorain Road, an <br />agreed upon modified variance to install a pole sign, a 37 square foot variance for area; a variance to <br />install a sign in the 35 foot triangular area, this has been modified so that the bottom of the sign shall be <br />8 feet from the ground with a maximum of 14 foot height. This motion does not require applicant to <br />return January 1, 1998. Violation of Ord. 90-125, Section 1163.11(a); 163.12B and 1163.26. The <br />motion was seconded by W. Purper, and uuanimously approved. Variances granted. <br />(Ms. Boyle arrived during this hearing). <br />3. Chris Perr,y, 24811 Tara Lynn Dr. . <br />Request for variance (1123.12). Request 12 foot rear yard variance to install patio enclosure. Violation <br />of Ord. 90-125, Section 1135.08(3). Also request special permit to add to a non-conforming dwelling <br />(front setback). Specialpermit required Ord. 90-125, Section 1165.02(b)(1). Chairman Gomersall called all interested parties before the board. The oath was admiuistered to Mr. <br />and Mrs. Perry, L. Wagner, contractor, and neighbor, Mr. Callahan. Mr. Wagner presented a brochure <br />showing the enclosure. The members had no problem with the request. Mrs. Mahon, and Mrs. Ball, <br />also neighbors, were sworn in at this time and were shown the plans and site plan. They were <br />concerned since it was a non-conforming dwelling. It was explained that the house was non- <br />conforming because it did not have a 50 foot front setback. It was determined that all the houses on <br />that street had 40 foot front setbacks. He explained that the patio enclosure will encroach by 12 feet in <br />the back. The neighbors voiced no objection W. Purper moved to grant the request of Chris Perry, <br />24811 Tara Lynn Drive, for a 12 foot rear yard variance to install patio enclosu.re. Violation of Ord. <br />90-125, Section 1135:08(3). Also to grant a special permit to add to a non-conforming dwelling (front <br />setback). Special permit required Ord. 90-125, Section 1165.02(b)(1). The motion was seconded by J. <br />Maloney, and unaniinously approved. Variance and special permit granted. <br />4. DaiU Queen, 24579 Lorain Rd. <br />Request for variance (1123.12). Request variances for pylon sign with changeable copy portion to <br />replace existing pole sign and attachment to pole sign: 81.4 square foot variance for total sign area; 2 <br />foot height variance; and 8 foot location variauce from right of way setback. Violation of Ord. 90-125, <br />Sections 1163.04(k); and 1163.12(b). Note: No other tenaporary signs or banners are to be used. <br />Chairmau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Romp and Mr. Hixon, sign contractor. Mr. Romp explained that the sign would be in the same <br />2
