I„- . ,. <br />Chairman Gomersall called all interested parties before the board. The oath was adviiuistered to Mr. and <br />Mrs. Viccarone, and neighbors, Ms. Koberna, and Ms. Smith, who wanted to see the plans. Since the <br />addition is in the back, it was pointed out that they would hardly see it firom across the street. They <br />were confused about it being a non-conforming dwelling, Mr. (pomersall explained that this had nothing <br />to do with the quality of the construction, that the house had been built too close to the lot line. Ms. <br />Smith noted that house had not been kept up well, especially since there were abandoned cars and <br />debris on the property. She is concerned that construction debris will not be removed. She was advised <br />to contact the Building Department. Mr. Gomersall suggested that Mr. Viccarone might take their <br />comments into consideration. J. Maloney moved to grant to J. Viccarone, 23735 Gessner Road, a 2 foot <br />side yard variance to construct a two story addition. Violation of Ord. 90-125, Section 1135.07(a). <br />Also request special permit to enlarge a non-conforming dwelling. Special permit required Ord. 90-125, <br />Section 1123.11. The motion was seconded by M. Boyle, a.nd unanimously approved. Variance granted. <br />11. Greg or Yvonne Theus, 5769 Fitch Rd. <br />Request for variance (1123.12). Request 2 foot height variance for fence. Violation of Ord. 90-125, <br />Section 1135.02(f-1). <br />Chairman Gomersall called all interested parties before the board. The oath was aduiuustered to Mr. and <br />Mrs. Theus, and neighbors, Mr. and Mrs. Heine (C. Downs) who live next door. The neighbors had no <br />problem with the fence. Mr. Gomersall agreed that the noise from I-480 was bad. Mr. Maloney stated <br />that when he was there someone was driving a motor scooter on the bike path. The 8 foot fence will not <br />obscure the highway, since it is higher than the house, but they hope it will help the noise problem. The <br />neighbor on the other side is Mr. Theus' mother and she has no objection. The members agreed that this <br />is an exceptional case with the highway in the back. Mr. Tlieus stated that they have been unsuccessful <br />in their attempts to get O.D.O.T. to put in sound barriers and they have been unable to sell their house. <br />He stated that the fence will be 8 feet in the back, but since the property slopes down, it will be lower <br />on the side. M. Boyle moved to grant the variance to Greg or Yvonne Theus, 5769 Fitch Road for a 2 <br />foot height variance for fence. Violation of Ord. 90-125, Section 1135.02(f-1). The motion was <br />seconded by R. Gomersall, and unanimously approved. Variance granted. <br />12. Doc & Louie's. 24280 Lorain Rd. <br />Request for variance (1123.12). Request 17.5 square foot variance for total sign area allowed for a <br />business use. Request variance to replace sign faces on existing non-conformiug pole sign which is in <br />the 35 ft prohibited triangular area and approximately 3 feet from right of way. Violation of Ord. 90- <br />125, Sections 1163.11(a) and 1163.19. NO'i'ES: Non-Conforming pole sign to be removed by January <br />1, 1998. Also If changeable copy is removed from pole sign 4 ft variance would be required instead of <br />17.5 square foot variance. <br />Chainnan Gomersall called all interested parties before the board. The oath was administered to Ms. <br />Benjamin and Mr. DiMichele, sign contractors, who explained that the owner will replace the pole sigu <br />by January 1, 1998, but he does not want the expense at this time. He would remove the changeable <br />copy if he has too, but he would prefer to keep it. It was agreed that they could keep the chaugeable <br />copy portion. W. Purper moved to grant the request to Doc & Louie's, 24280 Lorain Road, for a 17.5 <br />square foot variance for total sign area allowed for a business use. Also to grant a variance to replace <br />sign faces on an existing non-conforming pole sign wluch is in the 35 ft prohibited triangular area and <br />5
