<br />members agreed that would be better. Assistant Building Commissioner Rymarczyk advised that an 11 <br />foot variance would be needed. R. Gomersall moved to grant to Kevin Kilbane, 4134 Brendan Lane, a <br />?mutually agreed upon request for an 11 foot variance to install swimming pole in required side yard on <br />corner lot and a variance to have pool in side yard. Violation of Ord. 90-125, Sections 1135.02(I), and <br />1135.06(b). The motion was seconded by T. Kobema, and unauimously approved. Variances granted. <br />7. Pine Tree Beverage, 23239 Lorain Road. <br />Request for variance (1123.12). Request variance to install a new sign and sign cabinet on existing <br />non-conforming pole. Violation of Ord. 90-125, Section 1163.19. <br />Note: If sign were to be a ground sign variances would be required as follows: location variance to be <br />in 35 foot triangular area; 3 foot location variance for setback from right of way; and 12 foot side yard <br />variance for side yard setback. Also note: If approved, sign company is to certify that existing pole is <br />capable of supporting new signage, includ.ing wind load against pole and sign. <br />No temporary banners of anv tvue are to be displaved. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Phalgoo, sign contractor, who advised that he knew that the sign would have to be removed in 1998. <br />Mr. Purper is concerned about the Building Department's concem that the pole will not support the <br />sign and that the wind load should be considered. Mr. Phalgoo responded that they will certify that it <br />will or if it would not, they would replace the pole. It was clarified that this has to be done before the <br />building permit is issued. M. Boyle moved to grant the request of Pine Tree Beverage, 23239 Lorain <br />Road, for a variance to install a new sign and sign cabinet on existing non-conforming pole. Violation <br />of Ord. 90-125, Section 1163.19. Note: If sign were to be a ground sign variances would be required <br />as follows: location variance to be in 35 foot triangular area; 3 foot location variance for setback from <br />right of way; and 12 foot side yard variance for side yard setback. Also note: If approved, sign <br />company is to certify that existing pole is capable of supporting new signage, including wind load <br />against pole and sign. Request for variance (1123.12). Request 1 foot side yard variance and 5 foot rear yard variance to <br />replace earisting one car detached garage with a two car garage. Also request 168 square foot variance <br />for area of accessory structures which exceed 20% of tlie rear yard area. Violation of Ord. 90-125, <br />Sections 1135.02(c)(2) and 1135.02(d)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was admiuistered to Mr. <br />Wallen, who explained that he wanted the garage in that location in order to save a large tree. The <br />neighbor on the south was not present, but had stated that he had no problem with the request. W. <br />Purper moved to grant the request of Russ Wallen, 6014 Burns Road, for a 1 foot side yard variance <br />and a 5 foot rear yard variance to replace existing one car detached garage with a two car garage. Also <br />to grant a 168 -square foot variance for area of accessory structures which exceed 20% of the rear yard <br />area. Violation of Ord. 90-125, Sections 1135.02(c)(2) and 1135.02(d)(2). The motion was seconded <br />by J. Maloney, and unanimously approved. Variances granted. <br />9. Phft Brzeski, 27190 Pompton Drive. . <br />Request for variance (1123.12). Request 37.46 square foot variance for area of shed which will <br />. exceed the maximum 2% of the rear yard area that permitted. Violation of Ord. 90-125, Section <br />1135.02(d-1).
