Heard by plauning commission September 10; 1996. Heard by <br />architectural review board September 18, 1996 <br />Chairman Gomersall called all interested parties before the board. The oath was admiuistered to Mr. <br />Lichvarik and Mr. Rozukalns representing Fraternal Insurance. Mr. Gomersall noted plauniug <br />commission recommended approval. Mr. Lichvarik explained the variances and noted there is a <br />portico in frout of the entrance which will be wheel chair accessible. Mr. Puzper questioned if the <br />driveway on the east side of the building will be removed as architectural review board had <br />recommended. Mr. Rozukalns would like to maintain that driveway for deliveries. The members had <br />no fiuther questions. <br />M. Boyle moved to grant, the proposal of Fraternal Insurance Co., Orthodox Society of America, <br />located at 29510 Lorain Road, variances for the following: a 24 foot front setback variance to <br />construct a portico and a 26 foot side setback variance. Violation of Ord. 90-125, Section 1139.07. <br />Also grant a special permit to add to a non-conforming dwelling. Special permit required Ord. 90- <br />125, Section 1165.02. To approve the proposal including the recommendations of plauuing <br />commission. The motion was seconded by W. Purper and unanimously approved. Variances and <br />special permit granted. <br />5. Clu-is Fox, sublot 1 Barton Road NORTH of 6115 Barton Road. <br />Request for variance (1123.12). Request a variance to construct an accessory building prior to <br />construction of the dwelling. Violation of Ord. 90-125, Section 1135.02. <br />Also request a 184 square foot variance for area of storage barn, which exceeds the 200 square foot <br />maximum allowed. Violation of Ord. 90-125, Section 1135.02 (d-1). <br />Chairman Gomersall called all interested parties before the board. The oath was adininistered to Mr. <br />Fox, Mr. Smelter, Mr. Campbell, and Mr. Foraker. Mr. Ciomersall clarified the request is for a 384 <br />square foot storage shed to be constructed prior to building the home. He believed it was rather <br />unusual for someone to request a variance for a storage shed before the dwelling is built. Mr. Fox <br />explained that the shed is to be used for storing building materials used in the construction of the <br />dwelling. Mr. Foraker, a neighbor, believed that the lot is not buildable. He thought it was rather odd <br />for a shed to be built prior to the construction of the home. Law Director Gareau explained there are <br />provisions in the zoning code that compensate for buildings that are on lots that are less than "C" <br />zoning. He clarified variances will be required if the front, rear, and side yard setbacks are uot <br />maintained as required by code. Mr. Fox noted the appraisal company was informed by the building <br />department that the lot is slated for a residential dwelling. In response to Nlr. Gomersall's question, <br />Mr. Fox acknowledged, a building permit has not yet been applied for because the plans are in the <br />making. Mr. Koberna clarified this request is to build a storage shed on a vacant lot and has nothing <br />to do with the house. Mr. Purper was concerned about the possibility that after the shed is bualt, Mr. <br />Fox may decide not to build the home. Mr. Fox guaranteed that there will be a house built on this lot <br />next spring. Mr. Smelter, a neighbor, stated a building inspector had informed lum a 60 foot setback is <br />required on Barton Road, and wondered how far this storage shed wou.ld be setback. Mr. Goinersall <br />estimated the setback to be 700 feet. Mr. Smelter believed the storage barn would obstruct lus view <br />3
