Ms. Kodger explained that she was not <br />infoimed, of these violations, until April, six months after moving into the home. Sb.e.. :. ... ... <br />assumed, because the city took no action against the previous owner, the violations would be <br />iguored. Mr. Gomersall stated that the real estate agent had been-informed, and should have <br />informed Ms. Kodger. Building Commissioner Conway explained when he became aware of the <br />problem, the garage was vacant. The Realtor agreed, upon notification of tlus violation, that if the <br />home was ever sold or rented they would reconvert this garage. Ms. Boyle noted, the Realtor should <br />have informed Ms. Kodger of these conditions. Mr. Kodger pointed out there are other houses in <br />tlus community which do uot have garages and wondered why his mother is being picked on. Mr. <br />Gomersall stated that Ms. Kodger was informed in April, and agreed to address tlus situation at that <br />time. The Kodger's insisted they never agreed to correct the violation. Mr. Purper read an excerpt <br />fiom Build'vig Inspector Tousley's letter, which stated that Mr. Ken Kodger agreed to correct the <br />violatious by April 30, 1996. Ms. Kodger stated that Ken was not present to confinn or deny the <br />aforementioned agreement, however, she did not agree to correct the violations. Mr. Gomersall <br />wondered why anyone would buy this house without wondering why there is not a garage. Nrr. <br />Kodger stated that the code was written in 1992, and it does not address whether tlus pertains to <br />existing houses or new houses. Mr. Conway clarified, although the code was evaluated and modified <br />in 1991, the ordiuance to have a garage, with a structure, has been in the zouing code since the <br />1960's. Mr. Gomersall agaiu mentioned that there is a letter, from the Cinnamon Woods Condo <br />Association, voicing objection to tlus proposal. The association members and residents present felt <br />the letter was sufficient in voicing their coucerns aud had no further comments. Ms. Kodger noted <br />that she never received a copy of the letter from the association. Ms. Boyle stated that tlus is a public <br />record and Ms. Kodger is more than welcome to have a copy. W. Kodger noted lus mother never <br />received a copy of any of the prior correspondences either. Mr. Conway explained, he has all the <br />information available ou record, and Ms. Kodger certainly may have a copy. Tliere was no further <br />discussion on this case. <br />R. Goinersall moved to grant Rosemary Kodger, 7120 Bayberry Circle a variance to continue to use <br />home without a garage. Violation of Ord. 90-125, Section 1161.08. Note: Garage was converted to <br />a sales office with sliding glass doors and the garage area had been completely finished inside. Tlie <br />motion was seconded by T. Koberna. Roll call on motion: Gomersall, Koberna, Purper, and Boyle, <br />no. Variance denied. <br />10. Custom Tint (Harinon Glass) 25770 Loraiu Road. <br />Request for variance (1123.12). Request 45 square foot variance for excess sign area for a business <br />unit; request variauce to install individual tenant sigu on existing non-covforming pylon sigu; <br />request variance to have phone number on sign; and request 2 foot, 3.5 inch variance for height of <br />pylon sign. Violatiou of Ord. 90-125, Sections 1163.12 (a) &(h); 1163.03(c); and 1163.12(b). <br />Note: Both signs have been iustalled without permits and Custom Tiut is sharing building and office <br />with Harmon Glass. NOTE: Nou-conforming pylon sign must be removed by January 1, 1998. <br />Chau-man Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Chechowski, Mr. Hansen, and Mr. Barens. Mr. Gomersall asked if the Hai7non Glass sigu is <br />cunently a non-couforming sign. Building Commissiouer Conway responded that the pylou sigu, iu <br />the frout is uon-conformiug. Nlr.
