A -i <br />the building; some of the masonry will be painted; and an additional air conditioning unit will be <br />added on the roof. Mr. Walser stated the changes are mainly to improve the existing aesthetics. <br />He agreed, uuder the city's direction, to screen off the new air canditioning unit. Mr. Ma.uning <br />wondered if tlie building sigu cau be redesigned to conform with the code. W. Walser preferred <br />to apply for a variance as this is the "5iational trade dress" for Enterprise-Rent-A-Car. Mr. Koeth <br />noted the facia band on the south elevation will extend all the way across the windows. Mr. <br />Walser advised this band will be black and wlute. Mr. Koeth believed the entire front facade <br />becomes a sign. The inembers agreed this would become one enormous sign. Mr. Walser <br />believed this illuiniuated facia band is more professional. W. Brennan recommended removing the <br />band and iustalling the sign in the center of the building. Mr. Walser argued this sign presentation <br />is in keeping with the corporate identification. He clarified this facility will be opened from 7:00 <br />A.M. to 6:00 P.M. - Weekdays; 9:00 A.M. to noon - Saturdays; and closed Sunday. Mr. Walser <br />estimated they would employ two to four people. Mr. Breunan questioned where the dumpster <br />will be located. Mr. Walser advised there will not be a dumpster on this property, but noted they <br />are curreutly utilizing the dumpster on the bar's property next door. He believed, if that is not <br />pennitted, Lazy Boy may be willuig to share their duinpster. Mr. Herbster advised Lazy Boy will <br />be gone in a matter of 6 months. The members agreed to table the proposal uutil after the <br />arclutectural review board has reviewed it. Mr. Manuing clarified the materials; lighting; <br />landscaping; colors and aesthetics should be reviewed by the arclutectural review board. Upon <br />retuiving to planning comunissiou, the meinbers would like Mr. Walser to confii7n: a dumpster <br />site; the location and screeniug for the HVAC uiuts. Mr. Mauning wondered if Mr. Walser was <br />willing to agree ou something that would ineet the requirements of the code. Mr. Walser <br />requested a hearing before the board of zoning appeals for the signage. <br />A. Marming motioned to refer the proposal to board of zoning appeals with the recommendation <br />that the variances be granted with the following modifications: the phone number should be <br />eliminated fiom all the sigus; parkiug space # 10 should be removed; the ground sign should be <br />moved north to be in compliance with the setback requirements; the buildiug sign should be denied <br />unless it is modified to conform with the city code. The proposal shall return to the commission <br />with a lighting plan; site for a dumpster; and the HVAC units on the roof showing the screening; <br />and the colors of materials. Mr. Walser wondered if he would be permitted to use the Lazy Boy <br />property for the dumpster provided he can reach au agreemeut with the owner of the property. <br />1VIr. Manning Uelieved this would cause a problem if the owner of the property changes. Assistant <br />Law Director Dubelko advised this is uot a zoning code issue, as this issue comes in if the owner is <br />going to provide a dumpster the plauning commissiou has the authority to determine the location <br />of that dumpster. Mr. Dubelko quoted fi-oin section 941.03, wluch provides if there is going to be <br />a trash receptacle it must be in one location on the lot. He further advised provision 941.01 allows <br />for curb pick-up at a fee of tlu•ee dollars per week, however the limited ainount of trash allowed is <br />four twenty gallon coutainers. N1r. Dubellco did not believe that a trash receptacle is required, <br />however, if the property is littered with trash they could get cited for littering. Mr. Walser <br />wondered, facia baud would be cousidered a sigu if it were replaced with an awniug. Mr. Mauning <br />advised if the awning is illuminated it is considered a sigu. The inotion was seconded Uy R. Koeth <br />and unanimously approved. In the framing of the motion, it was clarified the proposal will be <br />reviewed by the various boards and cotnmissions in the following order: board of zoning appeals, <br />arclutectural review board, and then return to planuiug commission. <br />2) Twin Lakes Estates, property located between Lorain and Brad1ey Rds., West of Timber Trails <br />Subdivisiou. Proposal to constiuct Siugle Family Cluster Development. Rezoning will be <br />required.
