Ms. Reely clarified for Mr. <br />Manning, that the Federal Telecom Act of 1996 basically stated that these facilities could not be zoned <br />out entirely, the cities could not prohibit the carriers from providing service to an area, but the city can <br />still maiutaiu control over the placement, the appearance of the shelter, and the carriers will have to <br />work with the city. One of the reasons they chose the Clague Park location was to provide some <br />revenues back to the community, since they would have to pay for any lease. Ms. Kemey, a resident, <br />stated that AT&T had a meetiug about a week ago, and mailed out a letter to many residents. She <br />believed that this letter looked like a promotional bill and suggested that maybe people tossed it out. It <br />was a good meeting aud she believed that she was fairly well educated about this pole. She would be <br />opposed to it if the money does not go toward fixing up the park. She would like some written <br />guarautee that a lot of that $75,000. plus the monthly fee that AT&T is going to pay should go to the <br />park. Tlus pole might cause problems selling her house with the pole in her back yard, but having a nice <br />park to look at might make it better. She also complained that when she received the notice of this <br />meeting, she thought that this was all the commission was going to talk about, she did not know she <br />would have to sit her for three and a half hours before the issue was discussed. She believed that her <br />time was too valuable to waste, and thought that in the future people should be told that there is more <br />ou the agenda. Mr. Herbster stated that the commission did not know how long a hearing might last and <br />there have been instauces where representatives do not show up. Another resident thought at least the <br />residents should be told that there are other tlungs on the agenda. In reference to the proposal, Mayor <br />Boyle responded that the city is still in negotiating with AT&T, so the $75,000.00 and a rental payment <br />are their proposal to the city, not necessarily what is going to be agreed to. The second issue is that, in <br />Oluo, only a legislative body can appropriate monies, when the city signs an agreement, it goes to <br />Cou.ncil for approval then at that point the monies will be appropriated. The Mayor cannot agree to <br />where the money will go. He asked the audience to indicate if they would like the money to go into <br />improving Clague Park. Mayor Boyle asked that it be reflected in the minutes that the vast majority of <br />the 30 or 40 people present who live in the area would also like to see at least a lion's share of the <br />money go to park. He suggested that this portion of the minutes be highlighted and sent to cou.ncil so <br />that council is aware of this, and the city will address the residents later on specifics. He noted that <br />Councilinan Lind was present and has probably has taken note of this as well. So the first step has been <br />taken and this has become part of the miuutes. Once the city has come to an agreement, then what they <br />are suggesting can possibly become concrete. He stated that the administration would like to see a lot of <br />the money going into the Clague Park area for the fix up and improvements. However, none of what he <br />just said refers to the money used to rip up the ball fields, put in retention and redo the drainage. That <br />has nothing to do with tlus money. Mr. Hodge asked if this would take care of the water problems in <br />the park. Mayor Boyle responded that the retenrion that is being done now will affect the park, but it is <br />going to be there to clean up the residential area. He offered to talk to the residents about this privately <br />after the meeting. One resident, speaking from the audience, asked about the lighting in the area, and <br />was advised that there would be one light over the door on the east side, and would not illu.minate <br />behind the building. It was clarified that this would be in the north east corner, right offthe parking lot. <br />Neighbors discussed the exact location among themselves and were not certain where it would be. Mr. <br />Bradford advised that the site was staked out and the neighbors could see it. Mr. Mauning clarified that <br />the lighx would only go on when the equipment was being serviced. One resident was concerned that <br />children would congregate behind the building, or in the creek. Mr: Herbster stated that they would be <br />in the creek regardless. Mr. Manniug stated if there was a problem they should call the police. Ms. <br />Zayac, a resident, asked what the chart would show if there was no antenna in the park. Mr. Rhevus <br />explained that this would not be a completely white area (where reception would be poor). Councilman <br />Lind stated that he had a cellular phone there are areas where he gets very weak service, and he needs <br />the coverage for his calls. Initially, he was opposed to this going into a park, but he realizes this will <br />13
