asked Assistant Law Director Dubelko if the code requires a bar to be a certain distance from the <br />school building or just to the property line and was concerned that this was not in the riglit location. <br />Mr. Dubelko advised that tlus is a little more complicated issue, since this is an existing bar and license. <br />He needs to laiow how far it presently is from school property and how close it is going to be moved <br />toward that property. He stated that the code provides that the a bar should not be located within 500 <br />feet of any lot line of a lot on wluch there is an existiug school, if this is a vacant lot that is attached to a <br />school lot, there would be a difference, you would have to go back to the lot that the school is located <br />on. Mr. Brennan wondered how sure Mr. Potz would be that phase one would ever be built, since phase <br />two is being built first. Mr. Potz responded that the proposal would not be profitable without phase one. <br />W. Brennan questioned the need for so many light poles along the western drives. He noted that, even <br />if these lights are 400 watt metal halide, there would be a light pollution nuisance to a sleeping fireman. <br />Mr. Potz responded that the arclutect just intended to light the driveway, but that can be addressed to <br />correct the final plau. Chairmau Tallon advised that the plan shows these poles to be 18 foot, 6 inches. <br />Mr. Potz advised that the height of the front build.ing will be about 24 to 26 feet high with a 2 foot sign <br />in the front. The rear building will be about 19 feet high. Mr. Tallon advised that the light poles should <br />be 12 feet to the bottom of the light, with a maximum of a 250 watt bulb. W. Potz explained that there <br />would be ground mounted mechauical units, and they would be using a brick veneer to match the fire <br />station. Mr. Brennan stated that ther.e was no east elevation which would be the one facing the fire <br />station. Mr. Potz stated that it would be a solid brick wall and will be similar to the west elevation <br />without the gable and the entrance. The members discussed the proposal individually. Mr. Scott asked <br />how the next item on the agenda, the baseball field at Birch School, would affect this proposaL He was <br />told that the Law Department will be looking into this and reporting back at the next meeting. Mrs. <br />Koziol, a resident from Birch Circle here for another proposal, asked where all the water would go <br />since right now there is grass and trees and there is still standing water on Birch School property in the <br />spring and fall. She maintained that when they bu.ilt a commercial development on Lorain Road, they <br />covered the culvert, and now the water now creeps up through their back yards. She also questioned <br />why she was not notified of this item, since she can see and hear this property from here house. <br />Chairman Tallon advised that the drainage would have to comply with the rules and regulations of the <br />City of North Olmsted Engineering Department, and all water from that property must be contained on <br />its own properiy, and beoause of the retention requirements, it will yield less water than it does now. <br />City Engineer Deichmaun advised that they had to retain 90% runoff of a one year storm. As far as <br />notification is concerned, by ordinauce they aze mandated to notify only the adjacent property owners. <br />R. Tallon moved to refer the Metro Park Bu.ilders Office Retail Buildings, 24319-24345 Lorain Road. <br />(formerly VFW and Aquarium properties) proposal to construct two building in two phases to the <br />architectural review board and requesf that the developer upgrade the plans to include all the items that <br />were mentioned tonight to eliminate the variances, to address the concerns with the lighting, to present <br />a cut of the east elevation of the back bu.ilding, a photometric plan to see what the result of the lighting <br />will have on the Fire Department. Also to refer this to the Law Department for a clarification on the <br />ruliiig on the liquor establishment within certain confines accord.ing to the code. The motion was <br />seconded by T. Herbster, and unanimously approved. <br />5) North Olmsted Board of Education, 24100 Pa1m Drive <br />Proposal to construct baseball diamond on site of Birch SchooL <br />No representative from the board of education was present, but two representatives. of the Hot Stove <br />Association, R Murphy and D. Brooks, presented plans. Mr. Murphy explained that on February 24th <br />of this year they received approval from the board of education to construct a ball diamond on this <br />7
