<br />(15 and 17 on the plan) at the western end of the center. The developers agreed since it would increase <br />the depth of the landscaping by about 20 feet. The members discussed this individually with the <br />developers. Chairman Tallon explained to the audience that landbanking meant putting some of the <br />proposed parking into landscaping, and the parking could be installed, if the commission believed it was <br />necessary, at a later date, this would add 20 feet of landscaping by approximately 180 feet in one area <br />and approximately 150 feet in another. The audience was asked for their comments. Mrs. Canwright, <br />president of the Board of Country Club Condominium Association, made three points. First, only three <br />members of the board along with a couple of the residents met with the developers this past Saturday at <br />which time they presented this plan for the first time. They have had no time to discuss this plan with the <br />other members of the board. They have many concems with privacy, security, noise, control, or how <br />well, or poorly, this plan meets their concerns, and they not even had time to identify all their concems. <br />Neither have they had time to present this plan to the residents which will be essential considering the <br />broad scope of this work along their property line, so the association is not ready to come to an <br />agreement with the developers regarding this plan. Considering these issues, she is asking that this <br />proposal not be forwarded to any other board until they have a chance to work on an agreement. <br />Secondly, there is concem about the large scale demolition and reconstruction along the common <br />property lines, and they request that any agreed upon barrier be installed first before the demolition and <br />construction gets started in order to control noise and pollution. The third question is for Bu.ilding <br />Commissioner Conway concerning the placement of a superstore and an interpretation of the half mile <br />radius required, how is it measured, and how does the ordinance address all the parcels that make up <br />this retail space. She would also like clarification of the parking ordinance since she has heard that a <br />certain number of parking spaces must be provided, or is it a percentage of parking that is required. Mr. <br />Conway explained that the gross area of a bu.ilding can be reduced by 20% to allow for storage and the <br />parking will be figured for 80% of the remaining. He presented a d.rawing showing the half mile radius <br />and explained that this was not done by survey. The distance is measured from the intersecting point of <br />I-480 and the centerline of the botlevard. If there is any discussion or disagreement about this, the <br />developer could do a survey. This drawing shows that only a portion of this lot is within this half mile <br />radius. Mrs. Doubler, secretary of the Board of Managers of the Association, reiterated what the <br />president had said, that there had not been adequate time to discuss this. She is concerned about the <br />additional traffic that will be brought into an already congested area by a superstore and wondered how <br />this was going to impact Country Club Boulevard, Lorain Road, and Great Northem Boulevard. Mr. <br />Tallon stated that they have not seen a traffic study, and the commission does not know what is going in <br />there as yet. The commission could ask for a traffic study later. Mr. Barrow coufirmed that he still could <br />not identify the store at this time. He believed that the hours of the superstore were the standard retail <br />hours, 7 a.m. to 9 p.m., but it was not a 24 hour operation. Mrs. Doubler pointed out that 7:00 a.m. to <br />9:00 p.m. was not the normal retail hours in this center. Mr. Barrow disagreed pointing out that Home <br />Center operates a 12 to 14 hour day and he thought Comp USA was 7 to 9 as well. Some of the <br />audience believed that Comp USA opened at 10:00 a.m. and Mrs. Doubler stated that Marc's opened at <br />8:00 a.m. She is concerned about the 7:00 a.m opening and early morning deliveries. Mr. Barrow <br />reiterated that they would abide by the ordinance, and this should not be an issue. Assistant Law <br />Director Dubelko advised Mrs. Doubler that he did not have a copy of the noise ordinance with him, but <br />there are criminal penalties, and he will look them up if they call hixn. If a person calls the Police <br />Department at night and then notifies the Building Department during the day, and a city official <br />determines that the ordinance has been violated, the person will be cited and prosecuted in Rocky River <br />Municipal Court. Mrs. Doubler stated that a resident has called the police 10 times in 10 days reporting <br />violations ofthe noise ord.inances and there has been no response. Mr. Conway advised that it would be <br />best to follow up with a call to the Building Department. Mr. Dubelko stated that if there is a problem <br />with coordination between the Police and Building Department, it could be followed up by the Safety <br />Director who is the head of both departments.
