<br />neighbors property. Mr. Bartko presented pictures showing the water problems which he <br />maintained have been existing since this building was built. Mr. Bartko would like some kind of <br />verification that this will be done and will take care of his problems. In 1974 he was advised that <br />Manor Care would take care of the problems, but it never happened. This board cannot assure him, <br />but this will be forwarded on to the planning commission who can address these problems. Mr. Burk <br />explained that the plans presented to planning commission will show the catch basins in the <br />neighbors rear yards, and they will not be allowed to build anything until it is approved by the city <br />engineer. Mr. Bartko would like the board to send this information on to council. He was also <br />concerned that the bu.ilding plans were not proper according to the bu.ilding code since there is no <br />topograplucal drawing. Assistant Building Commissioner Rymarczyk advised that a topo was not <br />required for this meeting, this is only for the request of the special permit. This board will <br />recommend to planning commission and when council approves the special permit it should be <br />stipulated that the drainage and catch be subject to Engineering Department approvaL Mr. Behrend <br />further noted that this plan reflects the recommendations of planning commission that there be 150 <br />watt sodium lights with zero lighting on the properiy line. Chairmau Gomersall advised that this <br />board would be voting on the special permit to add to a non-conforming building. He noted that the <br />planning commission discussed all of this at their meeting. The members had no problem with the <br />special permit, but Mr. Maloney 'suggested that the motion should include that the planning <br />commission should take special note of the drainage. <br />J. Maloney moved to grant the request of Manor Care Nursing Home, 23225 Lorain Road, for a <br />special permit to add to a non-conforming building. Special permit required Ord. 90-125, Section <br />1165.02 also to include that planning commission take careful note. of the drainage problems on the <br />property and that tliey be clarified with the North Olmsted City Engineer's office for compliance. <br />The motion was seconded by R. Gomersall, and unanimously approved. Special permit granted. <br />Chairman Gomersall asked that it be noted in the record that these requests are all pursuant to <br />Council's approval of this and the approval could be over ridden within 30 days. The clerk advised <br />that this would be going to planning commission on June lOth, but no notification will be sent since <br />this was continued from the first meeting. <br />8. Ganley BNiW 25600 Lorain Road <br />Request for variance (1123.12). <br />Request the following variances to construct building addition with site improvements, landscaping <br />and building renovations: a 46' 8" front set back variance and a variance to display vehicles in the <br />75 foot front setback. Violation of Ord. 90-125, Section 1139.07. <br />Also request special permit to add to non-conforming building. <br />Specialpermit iequired Ord. 90-125; Section 1165.02(li). ? <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />P. Stoyanov, contractor, and Mr. Lisy, representing Ganley. Mr. Stoyanov presented the requests. <br />The variance is for a small triangle on the south east area of the building, the existing building is <br />non-conforming and they are merely filling in the corner. The second variance is to display vehicles <br />on concrete pads in the 75 foot front setback. The planuing commission had voted to approve the <br />request with certain recommendations. The revised site plan includes these recommendations. At <br />this time Mrs. Jung, the property owner next door, approached the board. She would like a fence <br />between her properiy and this proposaL Mr. Stoyanov responded that they were not planning to put <br />up a fence since her property was also commercial. Mr. Gomersall advised that there had been a <br />policy not to require fencing between commercial properties. Mrs. Jung stated that theirs is only a <br />small doctor's office and they were concerned that some of Ganley's customers would park in their
