. , . <br />PLANNING COMMISSION JANUARY 14, 1986 PAGE 4 <br />with the recommendation that the proposal not be approved because it is <br />the feeling that we would not want to create two non-conforming lots <br />and that a fiardship has not been shown which would indicate that the <br />property could not be sold as it is, seconded by E. Traczyk, and <br />unanimously approved. <br />2) Pebblebrook Subdivision, Preliminary Plan <br />Location is west off Canterbury Road at the south corporate line. <br />Proposal is to subdivide parcel 235-26-1 into fifty one (51) sublots. <br />Plans for 51 sublot subdivision were presented by Carl Andreano, Engineer, <br />and T. Janesik and B. Monche3n of Sunrise Development Co. Former pro- <br />posal with a different configuration of the streets was presented in <br />1979. Proposal is in the "A" residential area and all lots conform to <br />the code with the exception of the common property line between sublots <br />7 and 8 which is only 75 feet, and would need a variance from the Board <br />of Zoning Appeals-(square footage of-both lots exceed the maximum area . <br />required+). _ After some discussion it was decided by the developers-that <br />i£ the line were moved at.an angle, the required-135 feet depth would <br />be met and no_variance would be_required-(both lots would still conform . <br />to the required area). Canterbury Road will be partially extended, how- <br />ever, the remainder of the undeveloped dedicated right of way will abut <br />the rear property line of some of the lots. Mr. Gorris stated that <br />this portion of Canterbury Road could be vacated. Underground re- <br />tenti`an, water znain, and sanitary sewers wi11 be installed. Adjacent <br />nei;ghboxs, Mr. and Mrs. Scheeff and Mr, and Mrs. Kiser viewed the plans <br />a,nd pointed_out that the existing-Canterbury-Road 3s:no.tfup to'standards, <br />the cu3vert is undersized"and they question the-configuration-of--the= -- <br />undedicated--road- as 'shown'-on -the plan: ' They.'_ dwn all the property_-across- -- <br />ttie street and agree -that that- portion of-Canterbury-shouid =be vacated? - <br />They--have.no-pzoblem with the development.c..T. Morgan moved that=the - <br />Pebblelirook Subdivision Preliminary P1an, the subdivision of parcel <br />235-26"1.i7i,to fifty one suBlots, be approved as shown on the preliminary <br />plat.witfi the exception that the division line between lots 7 and 8 be conforning to the standard of 135' to make it a conforming parcel and <br />that the extension of the right of way lie terminated except that which <br />i`s-shown on the plat (south of the entrance to Walnut Lane) pending the <br />plot investigation of the Engineering Department into the actual dimen- <br />s.ions and dedication of the Canterbury Road right of way and to forward <br />this to the Safety Department and Engineering Department for their review, <br />seconded by J. Brown, and unanimously approved. <br />City Engineer Schaller advised that the Hennie Homes Proposal (retail <br />building at Lorain Road and S.R. 252) would probably be coming back to <br />the Commission since the developer has addressed the concerns of the <br />Oliio Department of Transportation. <br />V. COMMUNICATIONS: <br />Ord. 85-137: 'Section K is being revised to include all recreational vehicles <br />and clarifying that such vehicles cannot be stored in that side yard of a <br />corner 1ot which faces the street.---J.
