Proposal had received variances pre- <br />viously, however, Mr. DiBenedetto did not have the plat recorded. <br />Front portion of property facing Brookpark Extension is General Retail <br />and rear is zoned "A" residential. Planning Commission had previously <br />denied a rezoning of the parcel to General Retail. Mr. DiBenedetto <br />would still like property rezoned, however, he is requesting this sub- <br />division for residential lots. Mr. Coltman, representing Mrs. Koepke <br />and another neighbor, Mr: Klimkowitz again stated they.have no pro- <br />blems with the subdivision as long as it is for residential use. The <br />developer stated he is going to try to sell the property residentially. <br />T. Morgan moved to foYward to the Board of Zoning Appeals the proposal <br />to resubdivide the DiBenedetto Sub division parcels 232-25-5, 6, and 54, <br />approved in 1981, into three sublots and to forward all the information <br />relative to the minutes of the various Boards, and so forth, to the <br />Board of Zoning Appeals for their information; and that the Board of <br />Zoning Appeals keep in mind that in reviewing this request for the <br />variance that if commercial development is ultimately intended here, <br />that this subdivision would make it very difficult to use commercially, <br />that in fact, the parcel may have to be re-combined at some future date <br />and it may-be worthwhile to determine what the developer's_intent is <br />for these parcels prior to granting the variance, seconded by E. Traczyk, <br />and unanimously approved. <br />2) Patrick T. Kilbane Sub division. <br />Location is the east side of Columbia Road north of Gessner Road. <br />Proposal is to re-align the interior property line of parcels 231-19-40 <br />arcd . 2 31-19-41. <br />City Engineer Schaller explained that this would be re-aligning an in- <br />terior lot line to make two_50' wide lots (both non-conforming). The <br />existing parcel 2 now has 30' frontage with a Yarge rear portion; parcel <br />1 now conforms to code. An adjacent neighbor, Mrs. Elliott, pointed <br />out that the adjacent lots, in this area are all larger and that a house <br />could'be build on parcel-..2 if it was placed back further on the lot. <br />R. Bierman moved to refer this plan to the Board of Zoning Appeals with <br />the recommendation that due to the fact that they are taking one con- <br />forming lot and one non-conforming lot and creating two non-conforming <br />lots we recommend that they disapprove it, seconded by J. Wixted. Roll <br />call on motions Bierman, Wixted and Burns, yes. Morgan, Traczyk, and <br />Brown, No. Motion failed to pass. T. Morgan moved to forward the <br />proposed Kilbane subdivision to the Board of Zoning Appeals with no <br />recommendations from Planning Commission, seconded by E. Traczyk. Roll <br />call on motion: MorganB Traczyk., Bierman, and Brown, Yes. Wixted and <br />Burns, Motion passed. <br />3) Pebblebrook Subdivision, Preliminary Plan (Revised) <br />Location is west off Canterbury Road at the south corporate line. <br />Proposal is to subdivide parcels 235-25-11 and 235-26-1 into fifty nine <br />(59) sublots. <br />Mr. Tony Janesek, Sunrise Land Company, and Mr. Andreano, engineer, <br />presented revised plans and explained that they have purchased addi- <br />tional land (9 additional lots); existing house will remain on sublot
