BOARD OF ZONING APPEALS NOVEMBER 13, 1985 PAGE 2 <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Zika who explainedthat hewanted to keep shed near <br />ditch and that southern property line is adjacent to Olmsted Township and <br />is vacant. He will remove other shed on property and needs additional <br />storage for lawn and scouting equipment. Proposed shed would be 12' by <br />16' and 8' high. Z'his is practically the size of a garage and Board sug- <br />gested that he just put up another garage since he would still be within <br />the permitted 750 square feet of garage area. C. Remmel moved to grant <br />the variance, seconded by R. Bugala. Roll call on motion: Remmel, Bugala, <br />and Gomersall, Nay. Motion failed to pass. Variance denied. <br />5. Nancy C. Hastings, 5695 Allendale Rd. <br />Request for variance (1133.13). Request 14'6" rear yard variance for roof <br />over deck. Violation of Ord. 62-33, Section 1163.01. (Variance denied <br />September 4, 1985 - construction of roof differs from previous request.) <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Ms. Hastings, Ms. Schulzey, her friend, Mr. Devries, <br />the contractor, and neighbors Mr. E. Zvaigzne and Mr. LaJoe. Mr. Devries <br />explained that the type of roof has been changed: outside perimeter will be <br />fiberglass shingles to match the roof of the house and fiber glass will only <br />be in the middle, and this should eliminate previous objection that roof <br />looked like a carport. Neighbors still objected to the encroachment into <br />the green area of the neighborhood since rear area has never had sheds, <br />fences, decks, etc. Building Commissioner Gundy advised that a retractable <br />awning could be installed and would comply with the Zoning Code. Mr, <br />Devries stated that the permanent roof would be less objectional. Mr. <br />Bugala stated that this is too great an encroachment. C. Remmel moved to <br />grant the request, seconded by R. Gomersall. Roll call on motion: Remmel <br />and Gomersall, Yes. Bugala, Nay. Motion failed to pass. Variance denied. <br />Ms. Hasting was advised that she could come back in a year with this re- <br />quest or could change the size of the variance requested and return earlier. <br />6. Hennie Homes, property located west of John Knox church (25200 Lorain Rd.) <br />and east of proposed relocated S.R. 252. <br />Request continued until next meeting at the request of the developer. <br />7. Margaret Terrall, 5943 Fitch Rd. <br />Request for variance (1133.13). Request 10' front set back variance for <br />carport in front'of garage. Violation of Ord. 62-33, Section 1159.01. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Kemm, Patio Enclosures, who explained that Mrs. <br />Terrall is disabled and cannot get into the garage, and needs this pro- <br />tection to.kPe.p sidewa.lks and car clear of snow. He suggested that a <br />temporary variance could be granted during her ownership of the property. <br />Law Director Gareau stated that the variance would have to remain with the <br />property. Board felt that depth of carport could be reduced and still <br />serve the same purpose. Neighbor's house will obscure most of it on one <br />side and there are planting on the other. R. Gomersall moved to grant a <br />7z foot front set back variance for a car port in front of the garage for <br />Margaret Terrell with the provision that the carport will never be enclosed, <br />seconded by. R. Bugala, and unanimously approved.. Variance granted.
