BOARD OF ZONING APPEALS OCTOBER 2, 1985 PAGE 3 <br />was administered to D. Wellman, 26953 Kennedy Ridge Extension; M. & T. <br />Pekar, 5185 Whitethorn; R. Carlisle, representing Country Club Condominium <br />Association; Mr. Kunselman, 1559 LaClede; A. Himmel, M. Landisman, M. Skensik, <br />all representing Great Northern Village Apartments and the Westbury Apartments9 <br />K. Homolka, 25520 Clubside Dr.; Edward Bartoo, 5157 Whitethorn; Mr. and Mrs. <br />Kocab, 5165 Whitethorn Ave; F. Musicka, 5133 Whitethorn; J. Beck, 36960 <br />Kennedy Ridge Ext; J. Esgar, 5097 Whitethorn. Mr. Carlisle explained that <br />Biskind Development will be constructing a retail strip center on property <br />surrounding the existing Country Club recreational area, enclosing it on <br />three sides will 22' high buildings. Country Club Condominiums are propos- <br />ing to relocate the facility to the location show on the plan (adjacent <br />to Great Northern Village Apartments, Country Club Condominiums, rear and <br />side property lines of homes facing Whitethorn Ave. and vacant property to <br />the south). Mr. Carlisle responded to questions that there will be no <br />monetary gain from the development and this would be trading the two parcels <br />of land and constructing similar facilities. He also pointed out that this <br />use is a permitted one in a residential area, the pool and outdoor facilities <br />do not need any variances; variances are needed for building, parking, and <br />fence. Building is only 5° from Great Northern Village lot line, but is _ <br />60' away from their closest building and 150' from the nearest window;- build= <br />ing would act as a buffer between the apartment and the outside activities. <br />Because of the change of grade there is a natural 10` high buffer between <br />the parking area and the apartments and 51 high landscaping will be instal- <br />led on top of that. Neighbors had many complaints: the nbise that would re- <br />sult from such a facility; move is unnecessary since a buffer could be in- <br />stalled around the existing facility; proposal would intrude on the all <br />adult apartment complex next door; party room can be open until 1:30 a.m. light from area will be a nuisance; complex is not actually adjacent to <br />Country Club property; proposal will lower property values of *adjacent <br />neighbors,'while Country° Club's values will be increased; trash and debris <br />will be thrown onto adjacent property; doubted that plan is correct, }iouses <br />as shown on plan are further away than is actually the case. It was •hen <br />clarified that Mr. Carlisle was an employee of Biskind Development Co. Mr. <br />Carlisle stated that he is representing Country Club Condominium. It wris <br />again stated that the pool, tennis courts, and other outdoor facilitie!; do <br />not need variances; the noise from these facilities will be there wheflier <br />there is a building or not. Any lighting on this property cannot shJ,ie on <br />other property and proposal must have approvals from other boards prior to <br />permits being issued. Chairman Remmel called for a short recess. Meeting <br />was resumed. Neighbors mentioned a gas line that is supposedly on the pro- <br />perty. Neighbors stated further objections: additional traffic will be gen- <br />erated on an undedicated street, dangerous to children; pool and building <br />can be rented until 1:30 a.m.; move is not necessary, no hardship has been <br />proven, since they have an existing facility; all adjacent property owners <br />are opposed to the variance. Mr. Homolka of Country Clubs advised that <br />pool had been rented three times this past summer and that party room has <br />a capacity of 40 people. C. Remmel moved to grant the variance for the <br />country club building located less than 200' from the residential area of <br />Great Northern Village and Joseph Bauer Properties, this variance will be <br />predicated on only a membership: private country club, seconded by E. Graves. <br />Roll call on motion: Remmel, Graves, and Helon, Yes. Bugala and Gomrrsall, <br />Nay. Motion passed. Variance granted. Mr. Remmel, Mr. Graves, and Mr. <br />Helon explained the basis on which they reached their decision based on
