BOARD OF ZONING APPEALS JULY 10, 1985 PAGE 3 <br />was administered to Mr. and Mrs. Hevelone. They explained that the new <br />next door neighbors are going to put a boat beside thei'r:garage, and be- <br />cause their house is set 15' further back than the neighbors, it will be <br />right in front of their front windows. The adjacent lot is also higher <br />and a 5' fence will not screen the boat from their view. Board agreed <br />that 1 foot would not really help. R. Gomersall moved to grant the 1' <br />height variance for a fence at 5968 Wild Oak Dr, seconded by C. Remmel. <br />Roll call on motion: Gomersall, Yes. Remmel, Bugala, and Helon, Nay. <br />Motion failed to pass. Variance denied. , <br />6. Benno and Sandra Kauffmann, 23046 Summerland <br />Request for variance.(1133.13). Request 1' height variance for fence. <br />Violation of Ord. 62-33, Section 1151.04. <br />Chairman Remmel called all interested parties before the Board. Fence is <br />installed. Mrs. Kauffmann explained that the next door neighbor was oper- <br />ating a repair garage next door. The Kaufmanns have complained and they <br />have stopped repairing cars now and have cleaned up somewhat but the <br />propoerty is still not maintained properly. Adjacent property is lower <br />than the Kauffmanri's. Chairman Remmel administered the oath to Mr. and <br />Mrs. Kauffmann at this point. Mr. Bugala stated that fence is not instal- <br />led correctly. C. Remmel moved to grant the variance, seconded by R. <br />Bugala. Roll call on motion: Remmel, Bugala, Gomersall, and Helon, Nay. <br />Motion failed to pass. Variance denied. Chairman Remmel advised Mr. <br />Kauffmann that he has 30 days to remove fence and get a permit for a con- <br />forming 5' fence. <br />7. John Dalton, 3197 Clague Rd. <br />Request for special permit to add to non-conforming dwelling. Special <br />permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. J. Dalton. Mr. Remmel stated that this is a <br />worth while addition. R. Bugala moved to grant the special permit for a <br />non-conforming dwelling for John Dalton, 3197 Clague Rd., seconded by R. <br />Gomersall, and unanimously approved. Variance granted. <br />8. D. Steiner, 5561 S. Porter Rd. <br />'-Request for variance (1133.13). Request 11'4" variance for distance be- <br />tween patio enclosure and garage. Violation of Ord. 62-33, Section 1151.04-C. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Steiner. Board agreed this is much too close to <br />the garage. Mr. Steiner presented a revised plan which would only require <br />a 7'4" variance. Board agreed that this would be an improvement. C. <br />Remmel moved to grant the 7'4" variance between the patio enclosure and <br />garage as shown on the revised plan, seconded by R. Gomersall, and unani- <br />mously approved. Variance granted. <br />9. Mr. and Mrs. Mark Walker, 5653 Dorothy Dr. <br />r Request for variance (1133.13). Request 12' rear yard variance for patio <br />enclosure (already installed).Violation of Ord. 62-33, Section 1163.02. <br />Chairman Remmel called all interested parties before the Board. The oath
