BOARD OF ZONING APPEALS JUNE 12, 1985 PAGE 3 <br />Gomersall.. Roll call on motion: Remmel, Gommersall, Bugala, and Helon, <br />Nay. Motion failed to pass. Special permit denied. <br />8. Milan A. Mertus, 4632 Dover Center Rd. <br />Request special permit to add to non-conforming dwelling (front set back <br />over 70`). Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered_to Mr. -and Mrs. Mertus. Board has no problem with special. <br />permit.; however._there has been a complaint on cars on his property. -Board_- <br />suggested that-he remove the cars. C. Remmel- moved to_grant the special <br />permit, seconded by R. Bugala, and unanimously approved.-Special permit granted. <br />°. Richard Sumen, 6106 Fitch Rd. <br />Request special permit.to add to non-conforming dwelling (front set back-- <br />over 70').- -Special.permission required Ord. 62-33, Section 1231.02. Also <br />request 1' variance for distance between addition and adjacent detached <br />garage.. -Violation-.-of Ord._ 62-33, -Section_1151.04-C. <br />Chairman Remmel called a-1L inte-r-es-ted- -pa-rties before _the Board. The oath <br />was-administered to Mr: S.umen- and-Mr. Orr,-the contractor.---Plan seems <br />to be a great improvement, existing house will be renovated. C. Remmel <br />moved to grant the variance and the special permit, seconded by J. Helon, <br />and unanimously approved. Variance and special permit granted. <br />4. Shore West Construction Co.,. S/L 65, 30872 Windy Hollow <br />Continued at this point. <br />Chairman Remmel administered the oath -to Mr: Van Kuren, the adjacent-neigh- <br />bor who had not been notified. He questioned the site plan and thinks the <br />side line dimensions of his yard are incorrect. He has no problem with <br />proposal if lot lines are correct. Mr. Bugala would like the variance <br />granted with the restriction that no patio can be built. Law Director <br />Gareau stated that they have the right to put a patio slab on the property, <br />however, the buyer should-be notified that they will not get a variance for <br />an enclosed patio from the existing Board. Mr. Bower will advise the buyer <br />and will get a new survey of the side property lines. C. Remmel moved <br />to grant the 9' rear yard variance for this house as submitted in the <br />request on sublot 65, with the notation that the adjacent neighbor to the <br />west wants the side yard verified, seconded by-R. Bugala, and unanimously <br />approved. Variance granted. <br />10. Donald P. Gotlibowski, 2887 Clague Rd. <br />Request for variance (1133.13). Request variance for shed (rear yard has <br />less than 2,000 sq. ft.). Violation of Ord. 62-33, Section 1151.04. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. and Mrs. Gotlibowski. Board has no problems with <br />request. C. Remmel moved to grant the variance, seconded by J. Helon, and <br />unanimously approved. Variance granted. <br />11. Robert F. Brennan, 24207 and 24193 Mastick Rd. <br />Request for variance--(1133.13). Requesz--5' variance._for_width of two lots--
