Y <br />? <br />' PLANNING COMMISSION MAY 14, 1985 PAGE 3 <br />3) Pheasants Walk Subdivision - Phase Development Plan, location is north <br />off Lorain Road and east off Wellesley Ave. <br />Proposal is to separate the approved subdivision into phases of <br />development. <br />City Engineer Schaller explained that originally the subdivision had <br />been approved by Planning Commission and Council for 61 sublots. De- <br />veloper is now requesting approval to develop in phases, since they <br />cannot get financing for entire development. Phase 1 consists of 31 <br />sublots on Pheasants Walk Dr. from Lorain and terminating in a tem- <br />porary non-conforming (over 500') cul-de-sac; Wood Path Dr. would be <br />completed as planned to Wellesley. . the Engineering Department has <br />concerns regarding amounts for deposits: performance bonds, maintenance <br />bonds, and f inancial guarantees to the City that all improvements (for <br />the entire development) would be completed. Assistant Law Director <br />Dubelko recommended that the entire project be bonded in order to guar- <br />antee completion of the entire subdivision and that a def inite time <br />period for completion be agreed upon. Bond should be sufficient to <br />cover completion of the improvemerits by the City if necessary. Council- <br />man Wilamosky advised that the cul-de-sac on Wedgewood was supposedly <br />temporary, was completed 10 years ago•and the city is still living <br />with it. He suggested a split bond, one for the cul-de-sac area for <br />a specified period of time, perhaps 2 yeaYS,and one for phase 1 which <br />could be reduced as work is completed. Mr. Schaller stated that cul- <br />de-sac could be concrete where road is .to be continued, with asphalt <br />around outer circiimferance Mr. Puzzitiello, the developer, was not <br />agreeable to the bond for the second phase or the time limitation; <br />however, he would agree to the entire cul-de-sac being concrete. Ac- <br />cording to Mr. Dubelko, Planning Commission would have authority to <br />approve the temporary cul-de-sac, as long as bond would assure that <br />roadway will be completed; only Council could grant a variance for a <br />non-conforming cul-de-sac. Alternate proposal could be to end two <br />streets in legal 500' cul-de-sacs. This could result in the removal <br />of some trees which would remain otherwise. Chairman Burns and Mr. <br />Morgan agree that they prefer the plan the way it is submitted; this <br />would make for a more desirable subdivision; toQ many restrictions <br />could eliminate the development entirely. Mr. Dubelko stated three <br />options: 1) approve plan as submitted requiring bonds for both phases <br />2) plans be revised to make two legal cul-de-sacs with each phase <br />bonded individually; and 3) to approve as submitted to Council with <br />the contingency that Council grant the variance for the cul-de-sac. T. <br />Morgan moved to approve Pheasants Walk Subdivision as submitted ending <br />in a temporary cul-de-sac, the center portion of the cul-de-sac being <br />concrete, the ears (the outer diameter) being an acceptable material <br />and of proper minimum diameter required for a cul-de-sac, contingent <br />upon Council's approval of the granting of the 500' (length) variance <br />for the cul-de-sac and with the notation that there are two other <br />options, but that Planning Commission believes that this would be the <br />best plan for the City, seconded by E. Traczyk, and unanimously approved. <br />Mr. Burns was advised that the ordinance for the rezoning which was <br />required for Pheasants Walk has had its first reading. <br />V.
