Kennedy of Clark Oil', who explained that this <br />request is identical to a previous variance which was granted by the Board <br />in 1982 and has expired. It was explained to Mr. Kennedy that recently <br />the Board has been denying these variances and that Council has been un- <br />able to pass legislation setting guidelinesfor canopies. Members agree <br />that such legislation is needed. Mr. Bugala stated fhat many stations <br />are nowasking for different set back variances for these canopies and <br />there is no uniformity and there has to be some standards. Mr. Kennedy <br />stated that if he is being denied a variance, that there is no way <br />they could install a canopy which would conform to the 50' building set - <br />back (station was built in 1969 and pump islands did not have to conform <br />to 50' set back). He pointed out that his station could not be competa- <br />tive with other stations which do have canopies. Mr,. Kennedy was ad- <br />vised that if his variance is denied, he could return to the Board with <br />adifferent set back request, however, he could not request this exact <br />variance again for another year. R. Bugala moved to approve the 42'6" <br />front set back variance for Clark Oil Co., seconded by E. Graves. Roll <br />call on motion: Bugala, Graves, Helon,.Nay. -Remmel, Aye. Motion failed <br />to pass. Variance denied. <br />8. Roman Gardens, 4036 Brendan Lane <br />Request for variance (1133.13). Request variance to place dumpsters in <br />front yard. Violation of Ord. 62-33, Section 1125.76. <br />Chairman Remmel:"called all int.erested parties before the Board. The oath <br />was administered to Mr: Noe and Mrs. Krammer of Roman Gardens, and neigh- <br />bors, R. Beach, Mr. & Mrs. Strnad, J. Leonard, Mr. Plecha, D. Cav, Mr: and <br />Mrs.-Kerr, Mr: & Mrs. Ferenz and H. Mulhollan. Neighbors submitted names <br />and addresses to condominium representatives.. Mr. Noe explained that <br />they had been directed by the EPA to discontinue using incinerators, and <br />area behind garages (facing David Drive) is only place they feel is access- <br />ible. They nlan to screen them with Pyramidal Arborvitae. Neighbors <br />want dumpsters moved, not screened,,because of their looks and offensive <br />odor. Neighbors claim there was a fire in one previously. Mr. Graves <br />; questioned why dumpsters cannot be relocated somewhere within the complex; <br />?V' he found at.least_five places he thinks dumnsters could be relocated. Mr. <br />Noe'stated that there are no other places that would not interfer with <br />traffic or which would be convenient for trucks servicing them. It was <br />suggested that a compactor for each building would eliminate the problem. <br />Condominium is trying to make arrangements for City to pick up on tree lawn, <br />but no arrangements have been made as yet'. This would mean putting trash <br />bags on tree lawn which could possibly look worse. E. Graves moved to <br />grant the Roman Gardens the variance that they requested, seconded by C. <br />Remmel. Roll call on motion: Graves, Remmel, Bugala, and Helon, Nay. <br />Motion failed to pass. Variance denied. Mr. Noe asked how long they had <br />to remove dumpsters. C. Remmel moved to allow 10 days to remove dumpsters <br />from present location, seconded by J. Helon, and unanimously -approved. <br />9. Marathon Petroleum Co., Lorain and Butternut Ridge. <br />Request for variance (1133.13). Request 20' front set back variance (on <br />Lorain) for canopy. Violation of Ord. 62-33, Section 1174.02.
