<br />PLANNING COMMISSION JANUARY 10, 1984 PAGE 3 <br />Center, size of building that could be built would be severly restricted, <br />and, most importantly, Brookpark Ext. is now a boundry between general <br />retail and residential,property on Dover Rd. Mr. DiBenedetto asked <br />how he could use the one small segment alread zoned General Retail. <br />He stated that this property should have been zoned Retail when the <br />road was put in but an error was made and property was not recorded <br />correctly. J. Burns moved to reject the DiBenedetto rezoning request <br />based on the grounds that the parcel as it stands is a natural barrier <br />between residential and commercial property, seconded by J. Wixted, and <br />unanimously approved. <br />(2) Bellevue-Fitch Lot Split <br />Review of the plat for subdivideing original parcel 235-18-14 (which <br />was done by deed, without Planning Commission or Council approval) into <br />two (2) parcels; 235-18-14 and 235-18-113. Location is on the south <br />side of Bellevue Drive at the intersection of Fitch Road. <br />No representative was present. Mro McDermott explained that lot was <br />subdivided by deed in 1970 but had never been submitted to the City for <br />approval. Lot depth and area does not conform to todays code. Mr. <br />McDermott advised that since this had been subdivided for so long, <br />he did not send proposal to the Board of Zoning Appeals for variances. <br />The developer would like to build on the lot, and did receive vari- <br />ances for a house, since the city was not aware that property had not <br />been subdivided; the variances have expired. Proposal was explained <br />to the adjacent neighbors. Commission studied Minutes of the Board'of <br />Zoning appeals. Some neighbors preferred the vacant lot; others wanted <br />a house but they wanted it centered on lot, so that if backland is <br />eyer obtained by the builder, he will not be able to put in another <br />house with a 28' front yard. Positioning of house is not being decided <br />at this time. Couunission agreed that lot is really not buildable. <br />Assistant Law Director Dubelko advised that the lot does not meet re- <br />quirements of Zoning Code and as far as the City is concerned, lot <br />has never lieen subdivided and is still part of the front lot; Plan- <br />ning Commission can disapprove. B. Gorris moved to reject the request <br />for the Bellevue/Fitch lot split on the basis that sublot 1 which <br />would be cxeated would not be in conformance with the zoning law of the <br />City, seconded by T.-Morgan, and unanimously approved. <br />V.
