Mr. Burns pointed out that the vacant lot does <br />not meet minimum area and frontage requirements for General Retail <br />requirements. Property would have to be assembled with restaurant <br />property. Mr. Gorr-is is concerned since once property is rezoned, it <br />can then .be used for any permitted use, and future development could <br />not be controlled as long as parking conforms to code. Assistant <br />Law Director Dubei,ko stated that in his opinion, a variance could not <br />be.granted to use'property only for parking, and that the property <br />would have to be rezoned. Mr. Morgan stated that Commission has always <br />tried to maintain the balance between commercial and residential pro- <br />perty and that he, personally, resists the encroachment of commercial <br />property into residential areas.-. Mr. Georgolis stated that:this <br />.vacant property cannot be developed as it is now and this is not de- <br />sirable since it is overgrown and attracts rats. Mr. Suhayda stated <br />that the property is boxed in by General Retail property and cannot be <br />developed residentially. T. Morgan moved that the rezoning request of <br />_ parcel 232-28-25 located on the east side of Silverdale Road near Lo- <br />rain Road to rezone the property from B-Residence, Single, to Retail <br />Business, General, be denied, seconded by B. Gorris. Roll call oir <br />motion: Morgan, Gorris, Wxited, Brown, Aye. Burns and Traczyk, Nay. <br />Motion to deny passed. Mr. Georgolis was advised that he could now <br />apply to the City Council to request rezoning after the denial by <br />Planning _Commission. <br />Regarding question brought up at last meeting, Assistant City Engi- <br />neer D. McDermott reported that he had contacted Pheasants Walk <br />engineers, and that they are aware that the General Retail property <br />must be r.ezoned to Residential before f inal.Engineering Department <br />approval can be given. <br />V. COMM[JNICATIONS: <br />No items <br />VI. NEW BUSINESS: <br />Planning Commission will discuss vacation at next meeting. <br />VII. OLD BUSINESS: <br />Mr. McDermott presented the City Complex Landscape plans as requested by <br />the Commission on June 12th. Mr. Gorris believes that these are more <br />recent plans than those reviewed by Planning Commission prior to con- <br />struction. He thinks that there was some type of brick wall to obscure <br />the Service Department vehicles from the residential area on Dover Center <br />Road. Mr. Gorris stated that he thinks that the City Administration Com- <br />plex looks deplorable, especially the view of the service equipment from <br />Dover Center Rd. He thinks that to put a facility that looks like that <br />- in the middle of a residential area, while they (the City) send every- <br />body else to the Architectural Board of Review is ridiculous.
