<br />BOARD OF ZONING APPEALS JULY 6, 1983 PAGE 4 <br />13. Sohio, Lorain Rd. and Great Northern Blvd. <br />Request for variance (1133.13). Request 103.4 sq. ft. variance for <br />total sign area for signs on canopy. Violation of Ord. 62-33, Section <br />1221.06D and E3. <br />Both cases heard together. Chairman Remmel called all interested <br />parties before the Board. The oath was administered to A1 Schneider, <br />area engineer for Sohio. He explained that the variance was only for <br />a canopy. There are no set back requirements established for canopies <br />and required set back for buildings is 50 feet. The Board has requested <br />Council to set guidelines for canopies. Mr. Remmel stated that there <br />is no planned renovation of the building and that they could come in <br />with a plan that would be more in keeping with the present set back <br />requirements. Mr. Schneider pointed out that the set back requirements <br />were designed to keep buildings back from street, but that canopies <br />have no walls and do not obstruct vision. Mr. Graves stated the City <br />Council should write legislation to.set guidelines for canopies. Mr. <br />Schneider stated that the Shell station across from this station must <br />have been granted a variance for their canopy. The variance request <br />for signs if for additional signage on canopy. R. Bugala moved to <br />approve both variancesfor Sohio (canopy and signs), seconded by T. <br />Restifo. Roll call on motion: Bugala, Restifo, Graves, Horvath, and <br />Remmel, Nay. Motion failed to pass. Variances denied. Mr. Graves <br />suggested that Mr. Schneider talk with Mr. Woerple, chair-man of the <br />Building, Zoning, and Development Committee of Council about intro- <br />ducing legislation pertaining to canopies. <br />14. R. & M. Mariner, 4652 Brendan Circle <br />Request for variance (1133.13). Request 1' variance for fence. Vio- <br />lation of Ord. 62-33, Section 1151.04H. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Mrs. Mariner and a neighbor. Mrs. Mariner <br />explained that her fence would be connected to two 6' fences. Mr. <br />Remmel pointed out that there was a 5' fence on one side of property. <br />Neighbor had no objection. Mrs. Mariner stated that a five foot fence <br />would be unsightly next to the 6' fence. T. Restifo moved to grant <br />the variance, seconded by E. Graves. Roll call on motion: Restifo, <br />Graves, Horvath, Bugala, and Remmel, Nay. Motion failed to pass. <br />Variance denied. <br />15. Quality Mark House of Plumbing, 25770 Lorain Rd. <br />Request special permit. Request special permit to use non-conforming <br />pole sign (second pole sign on property). Special permission re- <br />quired Ord. 62-33, Section 1231.04. Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Mr. Vargo and P. Newell. Mr. Newell stated <br />that the present pole sign was not 3' off property line, but this <br />sign would be top mounted and would conform to the 3' requirement. <br />Building doesn't face Lorain Rd. and wall sign would not be seen
