BOARD OF ZONING APPEALS APRIL 6, 1983 - PAGE 3 <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Mrs. Wyman and Mr. Jett, an adjacent property <br />owner. The 6' fence is requested for a dog enclosure, 24' by 32'. <br />Mr. Jett had no objection. The Board questioned why a six foot <br />fence was necessary. 'Mrs. Wyman claims that neighborhood dogs <br />could jump a 5' fence and get in to her dogs. Mrs. Wyman is agree- <br />able to reducing?":size of fhe enclosure arid to moving the section of <br />fence adjacent to property line so that it will be in line with her <br />' house. C. Remmel moved to grant the variance9 seconded by T. Restifo. <br />Ir Roll call on motion: Remmel, Restifo, Bugala, Graves, and Horvath, <br />Nay. Motion failed to pass. Variance Denied. <br />9. Leo Woodman, 25915 Kennedy Ridge Rd. <br />Request for variance (1133.13). Request variance to construct garage <br />in front set back.. Violation of Ord. 62-33, Section 1213.01. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered. Mrs. Woodman explained that if the garage <br />? were placed adjacent to the house, several pine trees would have <br />to be removed, and also, because'of the slope of the land, much fill <br />would be needed. The Board agreed this garage would be in front of <br />of the adjacent house and possibly in front of new homes which might <br />be constructed on vacant land in the neighborhood. There is room for <br />alternate proposals. Building Cominissioner Gundy advised that if <br />they decided to attach the garage to the house, they would need a <br />special permit to add to a non-conforming dwelling, however, if a <br />detached garage is constructed in the rear set back'and is at least <br />20' from the house, no variance will be needed. T. Restifo moved to <br />grant the variance, seconded by E. Graves. Roll call on motion: <br />Restifo, Graves, Bugala; Horvath, and Remmel, Nay. Motion failed <br />to pass. Variance denied. <br />10. Roland W. Kohler, 23925 Maple Ridge Rd. <br />Request for variance (1133.13). Request 1' side yard variance and <br />2'10" rear yard variance for detached garage. Violation of Ord. 62-33, <br />Section 1151.04C. <br />Chairman Remmel called all interested parties before the Bo.ard. The <br />-" oath was administered to Mr. Kohler who explained that the original <br />garage had been 16" closer to the rear property line: The Board dis- <br />cussed'placing the garage 3' from the property line,£however, then <br />it would not conform to the required distance from his neighbors <br />" house. It was agreed that the variance as reques=ted would allow <br />enough room for ma.intaining the rear of the garage. E. Graves <br />moved to grant the variances, seconded by T. Restifo, and unanimously <br />approved. Variances granted. l-? <br />?. <br />11. Dennis Miller, 23477 Clifford Dr. <br />Request for variance (1133.13). Request 8.4' variance for distance <br />between addition and garage.
