Mr. Russell explained that Ohio Remodelers <br />built the patio and he was not aware that there was no permit for the <br />, job. It was noted that there had been no footers installed under the <br />patio slab. The Board requested the Building Department to investi- <br />gate fully and to cite Ohio Remodelers and withdraw their,license (if <br />they are licensed). R. Bugala moved to continue the Walter E. Russel <br />request for variance until the next meeting for review of all facts <br />until that review is complete „ seconded by E. Graves, and unani- . <br />mously approved. <br />4. Gerald A. Danzey, 4456 Lansing Dr. <br />? Request for variance (1133.13). Request 4 ft. side yard variance <br />? for i9arn (constructed under Building Permit #21038). Violation of <br />Ord. 62-33, Section 1151.04 E. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Mr. & Mrs. Danzey and Mr. & Mrs. Komar. Mrs. <br />Komar read a statement stating their objections to the barn. It stated <br />in part: that a'non-conforming tool shed was built without a permit <br />by Mr. Danzey right off their property line. Mr. Danzey was cited <br />by the Building Department., Since he had been considering"having <br />horses; lle moved the .shed 200' from all dweJ.lings. Later it was <br />determined that he was only approximately 6' off the property line, <br />not 10' as prescribed by code. The Komar's object to the stabling <br />of horses so close to their back yard and barbecue area. She also <br />stated the stable can be; seen from some of their windows. It was <br />pointed out that the lots are heavily wooded. Mr. Danzey stated <br />that they are probably not going to keep horses but there are <br />rabbits now. Mr. Danzey stated that he measured his lot from a <br />neighbors survey and that by error placed the barn approximately <br />4' closer to their lot line than allowed and that moving it 4' <br />would not make that much difference from Komar's yard. Mr. Remmel <br />stated that the barn is about 250' from the Komar house, the lot is <br />heavily wooded and theYe is a solid 5' fence now. There are several <br />barns with horses on that street. Councilman Wilamosky was sworn <br />in. He questioned if the variance would stay with the property and <br />if a.:new owner could keep animals. Law Director Gareau stated that <br />the barn was in conformance with the exception of the side lines <br />which were non-conforming. He also stated that a variance could be <br />granted with the stipulation that they could not have horses. R: <br />Bugala moved to grant the variance as requested with the stipulation <br />that should animals (as defined by the code) be housed in the struc- <br />ture that it would have to be moved to. conform to the side yard <br />requirements, seconded by E.
