BOARD OF ZONING APPEALS OCTOBER 6, 1982 PAGE 3 <br />oath was administered. Because of a variance granted previously this <br />fireplace will be only 3" off the property line. Mr. Jalovec advised <br />that he had been granted an easement on the adjacent property for <br />property maintenance. Building Commissioner Gundy stated that there <br />was no danger involved and that the chimney has to be 2' above any <br />building within 15' of the chimney. C. Remmel moved to grant the <br />variance for the fireplace with the provision that the height of the <br />chimney meets the code requirements, seconded by L. Horvath, and <br />unanimously approved. Variance granted. <br />6. Kevin McLaughlin, 24998 Deerfield Dr. <br />? Request for variance (1133.13). Request 1'10" side yard variance <br />and 1'2" variance for distance between dwellings for fireplace. <br />Vio1alion of Ord. 62-33, Section 1161.01. <br />Chairman Remmel called a11 interested parties before the Board. It <br />was agreed that there would be no problem with the request. L. Horvath <br />moved to grant the variance, seconded by.E. Graves, and unanimously <br />approved. Variance granted. <br />7. Mildred Moylan, 23668 Delmere Dr. <br />V Request for variance (1133.13). Request 1' height variance for <br />fence (rear property line). Violation of Ord. 62-33, Section 1151.04H. <br />Chairman Remmel called all interested parties before the Board. It <br />was pointed out that the adjacent fence to the left was not as high. <br />Mrs. Moylan stated that she needed the protection from the rear where <br />people are congregating and running through her property. Mr. Restifo <br />stated that one of the reasons stated on the application was to keep <br />her dogs in the yard. He did not feel that her dogs could jump a 5' <br />fence. Since she has a four foot fence on the side property line vandals ? <br />could jump over that very easily from the unfenced yard nex door. R. <br />Bugala moved to grant the variance, seconded by C. Remmel. Roll call <br />on motion: Bugala, Remmel, Graves, Horvath, and Restifo, Nay. Vari- <br />ance denied. t <br />8. Emil Palmieri (Mrs. C. Pierson), 3655 Beaumont Dr. <br />Request for variance (1133.13). Request location variance for tool <br />shed. Violation of Ord. 62-33, Section 1151.04 D. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Mr. & Mrs. Pierson, the tenants of the pro- <br />perty. It was pointed out that the shed was 10' x 12' not 10' x 10' <br />as applied for. Mr. Pierson did not think he needed a permit for an <br />aluminium shed. There is standing water in the location where the <br />shed should be placed. The Pierson's will be moving in May and will <br />be taking the shed with them. C. Remmel moved to grant this as a <br />temporary variance to apply only to June 1, 1982, at which time, if <br />the present renters are in that property, the request must be re- <br />reviewed at that time, this is not a permanent variance, seconded <br />by R.
