BOARD OF ZONING APPEALS OCTOBER 6, 1982 PAGE 4. shed. Violation of Ord. 62=33, Section 1151.04 D. Chairman Remmel called all interested parties before the Board. It was pointed out that to conform, the shed would have tq be placed j? 540' from the house. His neighbor stated he had no objection as long as the shed was built to code. R. Bugala moved to grant the variance, seconded by T. Restifo, and unanimously approved. Variance granted. 10. J. W. Leaty, 4000 Fielding Dr. Request for variance (1133.13). Request variance for location of and 6" lt:z?ight variance for tool shed. Violation of Ord. 62-33, Section 1151.04D Chairman Remmel called all interested parties before the Board. The oath was administered. Mr. Leaty produced a letter from the neighbor to the rear stating that he.had no objection to the shed. The shed was started becuase Mr. Leaty did not know.he needed a building per- mit. The request was amended because there is no location variance necessary. R. Bugala moved to approve the height variance, seconded by T. Restifo, and unanimously approved. Variance granted 11. Robert J. Murphy, 4292 Brendan Lane ? Request for variance (1133.13). Request 10' rear yard variance for patio enclosure. Violation of Ord. 62-33, Section 1163.01. Chairman Remmel called all interested parties before the Board. Mr. Remmel stated that there was no rear neighbor because the property back up to a school yard. L. Horvath moved to grant the variance, seconded by E. Graves, and unanimously approved. Variance granted. 12. Jerry Johnsen, 3399 Hunter Dr. Request for variance (1133.13). Request variance for location of tool shed (3' from each property line). Violation of Ord. 62-33, Section 1151.04D. I Chairman Remmel called all interested parties before the Board. The oath was administered. The size of the shed conforms. Mr. Finlan, the adjacent neighbor, stated that his objections were the same as had been stated previously (9/22/82). He also wants it to be clari- fied that the existing shed must be removed. He also stated that since this shed is smaller, it would not project out any further than the first proposal if it is placed 5' away from the lines. He is concerned about a fire hazard, since there is a wood pile adja- cent to the shed. C. Remmel moved to grant the 3' location variance from both side lines based on the removal of the existing shed, seconded by L. Horvath. Roll call on motion: Remmel and Horvath, Aye. Bugala, Graves, and Restifo, Nay. Request denied. 13o National City Bank, 26440 Lorain Rd. Request for variance (1133.13). Request front set back variance. Violation of Ord. 62-33, Section 1174.02. Also request Special Permit to add to non-conforming building. Special permission require Ord. 62-33, Section 1231.02.
