. <br />BOARD OF ZONING APPEALS NOVEMBER 11, 1981 PAGE 2 <br />addition and adjacent garage. Violation of Ord. 62-33, Section <br />1151.04C. <br />Chairman Remmel called all interested parties before the Board. <br />The oath was administered. The new site plan was to scale and <br />plan 2, an alternate plan, would.be 2' less so that the 50' <br />rear set back would conform to the ordinance (this variance had <br />not been stated in the original request). The appelants did not <br />want to reduce the size of the addition any more. It was stated <br />that this would be an extremely large house for the lot. Neighbors <br />did not object to the additzon according to Mr. Cowher. None were <br />present. C. Remmel moved to grant the variance, seconded by W. <br />Wasniak. Roll call on Motion: Remmel, Wasniak, Horvath, and <br />BugAla, Nay. Motion failed to pass. Request denied. <br />3. James A. Brown, 5352 Evergreen Dr. <br />Request for variance (1133.13)." Request variance for location of <br />tool shed (not 10' from rear property line). Violation of Ord. <br />62-33, Section 1151.04 D. <br />Chairman Remmel called all interested parties before the Board. <br />The oath was.administered. It was stated that the land 10' from <br />the property line is quite damp and the area where the shed is to <br />be locatedis screened with landscaping. L. Horvath moved to grant <br />the variance, seconded by R. Bugala, and unanimously approved. <br />4. Taco Bell, 24247 Lorain Rd-. <br />Request for variance (1133.13). Request 4' 8" side yard variance <br />for drive-thru window. Violation of Ord. 62-33, Section 1174.03 <br />Chairman Remmel called all interested parties before the Board. <br />The oath.was administered. Tfie drive thru window and driveway- <br />will be above the grade of the `sidewalk on.Coe_:Ave. The driveway <br />will be 5' from the sidewalk and could be a safety hazard if a car <br />slid over. John Marone of Taco Bell stated that the driveway would <br />have a curb and that a retaining wall could be installed. He did <br />not_.believe it would be possible to place the window on the other <br />side of the building. R. Bugala moved to approve the Taco Bell <br />Drive Thru window, seconded by C. Remmel. Roll Call on Motion: <br />Bugala, Remmel, Horvath, and Wasniak, Nay. Motion failed to pass. <br />Variance denied. <br />5. Canterbury Woods Homeowners.Assoc. (Max Cherney, President), <br />4010 Tennyson Drive. <br />Request for variance (1133.13). Request 1' variance for fence <br />(behind 3rd base on baseball diamond). Violation of Ord. 62-33, <br />Chairman Remmel called all interested parties before the Board. <br />The oath was administered. This fence is on the recreation area <br />baseball-diamond. L. Horvath moved to grant the variance, seconded
