`?. - . <br />PLANNING CAMNIISSION JUNE 24, 1980 PAGE 3 <br />(e) Minotti's Drive Thru Beverage Store and Car Wash, <br />27011 Lorain Rd. <br />Returned from the Architectural Board of Review Meeting <br />o f June 16, 19 80 . <br />No Representative was present. The plans were studied and <br />discussed in conjunction with the Architectural Board of <br />Review Minutes of June 16th. The Architectural Board had <br />approved the building and site plan with the condition that <br />the landscaping plan be resubmitted. The Architect had <br />complied with the Safety Director°s recommendations. The <br />Planning Commission had some questions for the Architect <br />' and wanted to review the Safety Director's report. J. Roberts <br />, moved to request an extension of time from the City Council <br />of 30 days pending clari.fication of plans by the Architect, <br />seconded by J. Brown, and unanimously approved. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />(a) Kennedy Acres Subdivision, Revised Preliminary Plan <br />Located South of the intersection of Whitethorn Ave. and <br />Kennedy Ridge Rd; Ztaenty four (24) sublots proposed from <br />existing parcels 235-4-1, 235-4-18, an d 235-4-21. <br />D. McDermott advised that this was a revised prelimi.nary <br />plan and th at the Developer had now complied with the <br />requirements of the Engineering Dep artment. There possibly <br />will be variances required, and if they cannot be worked out <br />on the final plat, the Developer will be required to ob- <br />tai.n the variances before the final plat can be approved. <br />These variances are: the Cul-de-sac exceeds the maximtun <br />length of 500' as requi.red, the building line on sublots <br />17 & 18 is 40' instead of the required 50', sublots 12 <br />and 18 may be below minimum square footage (this could be <br />rectified on the final plat). Mr. Rego, Attorney, and Mr. <br />Saylor, Engineer, represented the Bauer Development Co. <br />The open retention basin has been eliminated and there is <br />now an un derground system, the p roperty which was under- <br />water has been,sucessfully drained, the alignment of the <br />intersection has been improved as much as possible and is <br />satisfactory to the Engineering Dep artment. The developer <br />must finance the sewer system and he is planning to put in <br />a pressure pipe so that other property owners abutting the <br />sewer line will not be able to tie into it. The Law Director <br />has advised the Engineering Department that this is proper <br />even though it will be in the public right-of-way. The <br />adjacent property owners were invited to view the plans. <br />Mr. Weaver of River Road in Olmsted Falls, who owns adjacent <br />vacant property, question what obligation will he have to <br />.fulfill when the road is developed. Mr. Rego stated that <br />their position is that since Mr. Bauer would be bearing the. <br />costs that they would request that any future development
