BOARD OF ZONING APPEALS JULY 11, 1479 PAGE 3 <br />5. Myron & Margaret Russell, 23249 Westchester - Request for variance (1133.13). <br />Request 20' rear yard variance for addition. Violation of Ord. 62-33, <br />Section 1163.01. Also, request for special permit to add to non-conforming <br />dwelling, special permission required Ord. 62-33, Section 1151.01 E., <br />Chairman Ledvina called all interested parties before the Board. The oath <br />was administered. Mr. Remmel pointed out that there was a creek behind <br />the property, and a wooded area behind that, and that this variance would <br />really not interfer with any other property. Mr. DeVoto moved to grant the <br />variance,qseconded by Mr Remnel, and imanimously approved. Request granted. <br />? <br />6. Tony Savarino, 67 5 Stearns - Request for variance (1133.13) Request <br />4' sideyard variance for addition, violation of Ord. 62-33, Section 1161.01. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. Mr. Ledvina pointed out that the driveway was only <br />a foot off the property line at the point between the houses, and that this <br />could present a problem if the neighbor ever put up a fenceo Mr. Saverino <br />did not feel that this would be a problem for himo C. Remmel moved to <br />grant the variance, seconded by L. Horvath, and unanimously approved. Request <br />granted. 7. Robert Sherry, 24337 Maria Lane - Request for variance (1133.13). Request <br />4' rear yard variance. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administeredo The plans were studied and discussed. C. Remmel <br />moved to grant the variance, seconded by E. DeVoto, and imanimously <br />approved. Request granted, • ' <br />8. James H. Bussard, Jrm, 5547 Barton Rd. Request for variance (1133.13) <br />Request 220 sq. Ft. Variance for tool shed, Violation of Ord. 75-117, also <br />2° height variance, violation of Orde 75-117. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. It was pointed out that this was a 90 x 480 ft <br />lot backing up to Metropolitan Park. C. Remmel moved to grant the <br />variance, seconded by Mr. DeVoto, and unanimously approved. •Request granted. <br />9. Phillip Polomsky, Sr. 3942 Canterb ury Rd. - Request for variance (1133.13). <br />Request permission to sell plants in a residential area, violation of Ord. <br />62-33, Section 1151.01. Also, request to sell from a private greenhouse. <br />Violation of Ord. 62-33, Section -1125.36. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. Several of Mr. Polomsky's neighbors spoke against <br />the variance. Mr. Wagner, his next door neighbor complained that Mr. <br />Polomsky's back yard was littered with gardening supplies. Others said <br />that they were afraid that this b usiness might grow and become more of a <br />traffic problem than it is now. C. Remmel moved to reject the variance, <br />seconded by E. DeVoto, and unanimously app roved. Request denied.
