B. Gorris <br />moved to take Ord. 79-153 out of committee, seconded by J. Roberts, and unanimously approved. Assistant City Engineer D. McDermott <br />explained that if this street is vacated one parcel would be <br />landlocked, since the proposed Subdivision, PSaxine Circle, is <br />not at this time active and has been rejected by Council. Law <br />Director 14. Gareau advised that this vacation would not be legal if <br />it landlocked property. J. Saringer, cotmcilwoman, was advised <br />that if another praposal for a suodivision is introduced and <br />it provided for access to the landlocked preperty then the <br />residents canre-petition for vacation at that time. B. Jo?-ris: <br />moved to reject Ordinance 79-153 based on the opinion of the Law Director as to the legality of landlocking this parcel <br />of property; it seems that at this time the Planning Commission <br />has no other choice but to reject this proposal, seconded by- J. <br />Roberts, and unanimously approved. <br />3 Deerpath Subdivision No. 6. Revised Preliminary Plan; (orginal <br />Preliminary P1an reviewed and rejected by Planning Commission <br />November 13, 1979). Located north of I-480, west of Clague Road <br />and east of eastern end of Elm Road. 'Itaenty (20) sublots proposed <br />from existing Peiznenent Parcels Nos. 237-22-13, 14, 15, 16,29, 75, <br />and 237-23-26. Note: This Revised Plan does not conform to the <br />North Olms ted Platting Ordinance 64-95 and 73-25, Section 3(C) , <br />I tem 13 a. <br />3a,Elm Road (East. end segment) Vacation Proposal. Proposed vacation <br />is actually part of Item No. 3 above (Deerpath Subdivision No. 6) <br />and should be considered concurrently with that subdivision proposal. <br />Assis tant City Engineer D. I4cDermott introduced the plans and ex- <br />plained that this proposal differs from the first in that an access <br />road to Clague Road was added; hoxaever, the access road is only <br />50' wide and not the required 60', and that sublots 14 and 15 (the <br />original dedicated Elm Rd. ) a-re still proposed over the sewer ease- <br />ment as it was on the plans which were rejected on November 13, 1979. <br />Mr. Roger Clingman requested that the letter by City Engineer R. <br />Zurawski ob jecting to building over the sewer easement be read. <br />Secretary J. Brown read the letter from the Planning Commission <br />Minutes of November 13, 1979. Mr. Clingman felt that an opinion <br />should be from the Law Department based on what rights were granted <br />by the easement. M.
