Board of Zoning Appeals 4-6-77 <br />-3- <br />for variance (1133-13). Request for side yard variance for 6.7 ft. x 6.7 ft. <br />gas regulator bldg. located at side of proposed roadway. Violation of Orse <br />62-33 Section 1161s01, (Also, building becomes non-conforming). <br />Chaixman Ledvina invited the applicant and all other interested persons to as- <br />semble before the Board. All witnesses, before testifying, were sworn in.Law <br />Director Gareau was called upon to explain the cause for hearing and stated <br />for the record "This building houses gas regulator equipment, was not shown on <br />the original development plan,approved by Planning Commission and Council."The <br />building of the roadway made the structure obvious and the only legal concern of the Board is the request pertaining to the structure location in relation- ship to the new right of way line.t° Evidence furnished by City Fngineer Childs. <br />was introduced from the Ohio Department of natural Resources Division of Oi1 . <br />and Gase The City has no jurisdiction, no state law governing new streets a- <br />longside operating wells. A guardrail is a worthwhile precaution. Councilmen <br />Fairfield and tiriilamosky joined the discussion stating their concern for the • <br />welfare and safety of residents. Mr. Sexton, describing himself as a gas ex- . <br />pert, declared the gas well is unsafe. Several other neighbors voiced their • <br />concern and objections. Chairman Ledvina reminded the audience of the specific <br />matter before the Board. A mption wap made by Mr,.Remmel to deny the request,• <br />seconded by Mrm Huntington, Mr, Gareau reminded the Board that if the structure <br />is removed the gas piping will remain i.n an exposed state. Exposed piping was , <br />discussed. Roll Call on the motion: All members voted yes. The variance was : <br />not approved. <br />10, Shore West Construction Co,0 23826 Zorain Rd. Request for variance (1133•130 <br />Request for side yard variance for.corner lot (Sub Lot 43 Brendan Lane). Vio.-. ? <br />la+ion of Ord. 62-33 Section 1159.02. <br />Chairman Zedvina invited the applicant and all other interested persons to as =7 <br />semble before the Board. Al1 witnesses, before testifying,.were sworn in. The <br />simila»ity of Case No. 10 and No. 11 was noted and a decision to consider both <br />was made. - <br />11. Shore West Construction Co „ 23826 Lorain Rd. Request for variance (1133•13). <br />Request.for side yard variance for corner lot (Sub Lot 41 Brendan Zane), 'Vio- <br />lation of Ord. 62.-33 Section 11590020 <br />The Board studied the site and building plans. The extension of Elm and Clague <br />is doubtful, Surrounding lots were considered. Motion was made by Mrr. Pemmel <br />to approve*the request on Sub Lot 43, seconded by Nhr, Hami.l7,. Roll Call on mo- <br />tion: Messrs• Remmel and Hamill., yes; Messrs. Huntington and Ledvina, no. Var- <br />iance not approved, Motion was made by Mr. Remmel to approve the variance on <br />Sub Lot 41; seconded by Mr. Hamill. Roll Ca1.l on motion: Messrs. Remmel and <br />Hami11, yes; Messrst Huntington ancl Ledvina9 no. Variance not approved. <br />12. Tony Dudsak, 4452 W. Ranchview Ave. Request for varianee (1133•13). , Request <br />for permit for existing tool shed. Tonl shed is located in violation of Ord. <br />75-117. <br />Chairman Ledvina invited the applicant and a11 other interested persons to as- <br />semble before the Board. Al1 witnesses, before testifying, were sworn in. <br />Board members had visited the site. Shed is well shielded by shrubs. Mr. Rem- <br />mel made a motion to approve the request, seconded by Mr. Hamill. Roll Call on <br />motiona All membexs uoted yes-. The variance was appraved.
